The hand he has holding up is the one that the gun is in. This is right before the driver unloads. So the guy was pointing the gun at the driver after banging it on the truck.
Either way, I still say easily self defense, but it looks like he switches the gun to his left and points at the driver with his right.
Still…from the vantage point of truck guy, you know this crazy idiot has a gun whether he pointed it or not, so cleared hot either way IMO.

You didn’t see the part right before the shots where the guy that got killed pointed his gun towards the driver?

You're going to need to rewatch it, maybe put your glasses on, and maybe slow it down for yourself so you can see what you just said isn't accurate.
Not that it changes the fact that he 100% deserved to get shot multiple times.
You're right, he switched hands.
But it was completely out of the view of the driver (happened below the waist) AND the hand he raised was the one the gun was in when he banged on the door.
No reason for the driver to believe it wasn't still in that hand in that quick of a moment.

This is like a WYHI thread where the obvious answer is IWHI.
The more interesting question of whether or not it would be self defense is if the dead guy did exactly what he did but without a firearm. Even in that case I think there is a 50/50 chance the shooter walks on self defense.

On a side note, I can only imagine how loud that must have been from inside the truck. Dude's eardrums must have been ringing for quite a while.

It’s a stretch to call that self defense

It honestly is so clear it should be used as the video for self defense on wiki

You must work for the Secret Service. Man pounding on your window with a gun in his hands and you won't defend yourself until shot at first? Idiot. You would likely have died in this scenario. Good luck in life!

Even without the firearm it meets the threshold of self-defense the way the Indiana law is written.
quote:
(d) A person:
(1) is justified in using reasonable force, including deadly force, against any other person; and
(2) does not have a duty to retreat;
if the person reasonably believes that the force is necessary to prevent or terminate the other person's unlawful entry of or attack on the person's dwelling, curtilage, or occupied motor vehicle.
I think he could reasonably assume the guy was trying to get into the truck to harm him.

Shooter did the wife a favor in the long run.

IMO, to show how big of an idiot this guy was to do this to his new family over a stupid traffic incident.

This is why I drive defensively, I stay several car lengths back from people, etc. Much less likely to even get involved in a road rage situation if you don't let bad drivers enrage you in the first place.

He had every legal right to shoot him the second he exited his car with a gun and started walking to him. He honestly waited too long to shoot him imho. Lucky he didn’t get killed himself
