I think a large portion of this thread is not aware that this does not apply once someone has been convicted

So I’m pretty sure this would a blatant violation of the 1st Amendment

And while the press might have a First Amendment right to publish the photos, it does not have a First Amendment right to access them.

A booking photo becomes part of a public record when it is taken. Just like a the booking list, and incident reports.

What is the limit of publication, is it addressed in the article?

I guess media organizations can troll someone on Facebook and lift their FB profile pic and use that to circumvent the law since it is not a booking photo.

I actually believe this is a good law. There are times that people get arrested for things they did not do and have not been found guilty yet. Those pics stay up forever.
Agreed. I bet people against this law would change their tune if they were falsely accused of sexual assault or something similar.

Don’t have to post mugshots to tell most of the time.

Names are typically a dead giveaway, as well as addresses. Combine those with Google Images and you can quickly separate the civilian population from revelers.

Family friend, middle aged middle class lady had a few too many glasses of wine and foolishly drove afterward. No excuses, she did wrong and paid the penalty. This was about three years ago and she hasn't offended again. One of those mug shot websites picked up her picture and if you Google her name it's still out there. I don't see how this serves any public good.

She remembers it everytime she thinks about driving drunk. That's the good it serves.

You bootlickers that think this is bad…

Do you understand how many people are wrongfully accused and never convicted? All it take is a #believeallwomen to say you assaulted her and whenever your potential employer googles your name they find a mugshot.

For people that hate the government so much you sure put a lot of blind faith in them.

It's different if someone is an imminent threat to the public.

Otherwise, I don't see the purpose in publishing someone's name or photo before they are tried. We have due process in this country.

I follow all major news outlets in England. The common practice there is to only announce names/photos after conviction. Morally this is a better practice. Innocent peoples lives are routinely ruined by false accusations.

THE PROBLEM is that the current trend of lax DAs and judges leads to less convictions than are warranted.

Personally, I would be fine with withholding names and photos from all those charged with crimes until they are found GUILTY. As long as this applied to EVERYONE. The current practice only protects certain groups.

The only problem I have with the proposed bill is that once you give these politicians an inch they take a mile the next time. "The photos are already suppressed so now the entire arrest record is sealed."

We have the same law here. It's not been an issue. Most people will have no problem putting their own images up on FB/Twitter/IG and the media just scrapes them instead.

In the USA millions are arrested each year, but in Louisiana only 200,000 ish are made annually.
