the system is totally broken the ones with no injury make money and the people that really get fricked up typically get fricked unless they are smart enough to pay for uninsured or underinsured coverage or lucky enough to get hit by a business or someone smart enough to buy more than minimum.

A large percentage of this boards first recommendation after any type of accident is to sue. It’s not just the political system, it’s baked into the culture of LA

This trial lawyer industry that we have here in Louisiana is a scourge on the Citizens of this state.
It hinders the growth of honest businesses here in the state. It also makes us look like a bunch of backwards inbred idiot hicks to the rest of the country .

It’s funny because about a year ago, I was at a red light and an old man rear ended me. He was doing 2 maybe 3 mph tops not a scratch on my truck, barely bumped me forward, honestly at first I thought it was the stupid auto stop on my truck starting my truck back up. It damaged his car because he hit my ball hitch. We made a police report (cops didn’t even come out we did it over the phone which was a first for me). About 2 weeks later his insurance company called and said “we haven’t gotten anything from you or a damage report” I went that’s because there is no damage, and no one was hurt, nothing to submit. Honestly the lady on the phone you could tell was kinda shocked like “ummm so you’re not claiming anything” I told her no mam nothing on my end to claim. She was like “so it’s ok if I close your side of this” I said “yeah nothing to claim so you can close it” and she was like “oh ok I will close it then” it’s like they were expecting me to be like I was injured and this and that

My dad and I always debate on this. A lot of insurance managers thrive on "the only good claim is a closed claim" and cite a very real chance of trial risk. Ignorant juries see big bad insurance companies and can/will stick it to them. That being said, this mindset has led to lawyers bringing up stupid cases and getting a settlement purely because insurance companies are afraid of idiot juries.

Then make the insurance companies change their policies. The amount of money they'd spend in legal fees would far surpass what the plaintiffs are going to settle for. So it's cheaper for them to just throw out some lowball settlement. So they Insurance companies have their cake and eat it too.

Something like that, I would have got out, saw no damage, and got back in my car and left. Then deny you hit her. Your word against hers.

I did record everything. I took pictures and recorded a video of her talking to her uncle, and then her uncle coming to push and push on the rear bumper facial, (he didn’t damage anything) but I have it all on video, even have on video the police taking her report and mine, close up pics of her car my truck, EVERYTHING. Only thing I don’t have on video is the little tap that happened on Lobdell.

And sent 10-11 pictures and like 5 videos all to my insurance company. And they even got the body cam footage from BRPD

And what they are suing for is absolutely NO vehicle damage. The State Farm rep even said they are not making a single payout to anyone me or the girl for any vehicle damage at all. It’s all for her being hurt, missing work, and pain and suffering..

she'll get paid just depends on how far her lawyer wants to take it and do the medical theatre.

Now imagine all the uninsured motorists on the road.

It should be a felony to drive without insurance. First time offenders, 90 day jail time.

Laugh all you want but my buddy got into a motorcycle accident caused by an uninsured motorist who pulled out in front of him. Was in critical condition and had to go through extensive physical therapy etc.

What happened to the uninsured motorist?.. fricking nothing.

They ended up suing her due to the fact the uninsured was driving on the clock at the time of the accident, and employer fought it saying they weren’t responsible etc.,

shite is so fricked up in this country.

Same thing happened to me. A young pregnant girl, no damage, no injury, no cops. We exchanged insurance info. She went home, the family got in her head, next thing you know she wanted 10K from my insurance company and my rates took off like a bottle rocket.

Yup, sadly I can say when my insurance company called me I wasn’t surprised. I had a feeling this was going to happen. Because when we parked, she said she was calling BRPD to make a report, and she was sitting in her car going a mile a minute calling and texting people. And after 10 mins I knocked on her window and was like did you even call BRPD and she was like oh I’m actually calling now. So I waited another 5ish mins and called them myself and they told me an officer was in route … so when I got that call from State Farm I was honestly like yep

Insurance is a business and business needs to make money. Unfortunately, Louisiana is an insurers worst night mare

Horrible jurisdictional environment for liability exposure and terrible coastal risk for property exposure

Insurers are willing to accept the coastal exposure if they can make money in the liability side but litigation here is out of control. 70million dollar settlements for auto injuries! How is that even possible!?

We can’t change our coastal risk but we sure can change our litigation environment. We need tort reform. Stop plaintiff attorneys from cashing in.
