Yep. It's this simple.

Everyone in louisiana knows your vehicle touching someone else's is basically an automatic lawsuit where the "victim" is fishing for the winning ghetto lotto ticket.

It's not frivolous, though. He's the at fault driver. Liability is 100% OP, 0% her.

With loser pays, OP's insurance would pay even more.

A very similar thing happened to me when I lived in Lake Charles in 2019. Was pulling out of the Kroger parking lot and the car in front of me stopped short and I hit her. Not a scratch on either of our cars, but she had a 2 year old son in the car. She got out and was hysterically crying saying both her and her son where hurt. She had her whole entire family show up (literally 12 people). An ambulance, firetruck, 3 police officers all came in hot. The officer writing the report told me "yea im sorry about this but your insurance rate is about to sky rocket."

My insurance settled with this girl for 20K. This was her third insurance payment in the last 18 month. This girl was my age.

TL,DR: Insurance rates will never go down because POS plaintiff attorneys can make money on anything.

Sad thing is, cops don't even care if a vehicle is even registered anymore. I see cars all over BR almost every day that don't even have a license plate or a temp tag. I've even seen cops pass by such cases and if it's noticeable to me, it sure has to be noticeable for them. Yet they don't pull them over and let them go on their merry way. It doesn't make sense to me.

Get all the unregistered and uninsured drivers off the road and I'll bet every cent I got in the bank that claims drastically decrease which in turn will lower premiums across the board. All that happens to them now is their license gets flagged at the DMV but they have no problem being unregistered and uninsured, so being unlicensed isn't going to deter them either. Jail time might seem steep but it'll be a much more effective deterrent than any deterrents that exist currently.

So faking injury, which is almost certainly the case here, isn't a frivolous claim?

I don't understand this at all. I remember growing up going with my grandfather to renew registration and him explaining to me how much trouble you could get in if you didn't keep up with her registration and plate etc. Now people drive without one even on the vehicle and nothign happens.

Police don't enforce damn near anything since 2020.

It’s fricking messed up. I wasn’t doing anything wrong, wasn’t on my phone, had oil on the bottom of my boots from work and forgot my other pair of shoes at home so I had to get the paper floor mats from work. Foot just slipped off the brake pedal, I’m telling you I coulda kicked the back of her bumper facial and it would have been harder than the actual impact my truck made. Not once single scratch on either of our vehicles, honestly if she wouldn’t have gotten out the car I wouldn’t have known I hit her, at first I thought when I slammed on my brakes my truck bouncing was all that happened… and yet my insurance is going to give her a settlement for no other reason than being ghetto trash and like others have said hitting the ghetto lotto.

Why are premiums for insurance so high around Louisiana BECAUSE OF GHETTO arse TRASH LIKE THIS GIRL

Now if I would have smashed into her car and done some real damage ok yeah I would get it and be like well it’s justified. But this nah she deserves jail time for this crap people like this girl suing my insurance is the reason why we all pay so much

Fault has nothing to do with it being frivolous. If there isn't even a spec of damage, then there's nothing to sue for. Vehicles are designed to withstand a minimal impact with zero damage on front and back. It sounds like that happened here. If there's no damage to either vehicle, then it's 100% certain no one has an injury.

I can't even think of a scenario where a person could be injured in this situation. Maybe they spilled hot coffee on themselves or something.

Never once claimed I wasn’t at fault. Yeah I was not denying it. Point of it is, our insurance rates are through the roof due to people like this faking a injury

She could have stubbed her toe or gotten a paper cut and would have be a 100x worse injury than from this car accident

The legislature is dominated by LSU Law and Southern Law grads. They aren't going to cut the throat of their own golden goose.

The big issue with suits is that sometimes it is cheaper for State Farm to write a check than to fight for the 30k. Because they could spend thousands trying to defend the case.

That is why there needs to be an effort to make a plantiff and plantiff's attorneys think twice about suing espcially if they have a losing hand.


The way it is now, if you file suit, then it gets settled fairly quickly because they don't want to escalate their legal costs.

Also regardless of the outcome, the insurance is on the hook for the legal costs of both sides, unless a case is dismissed for being frivolous.
