Sure, but the business is much less likely to fight the long drawn out, expensive, good fight over a scenario they will likely only face 1 time.

I'm not arguing that point at all. I'm saying that because they choose that path of least resistance, it has created an environment where lawyers know they can likely get an easy, out of court settlement for a quick pay day. So if you have a complaint about frivolous lawsuits over this, blame can equally be placed on the businesses that choose not to fight those frivolous suits, as can be placed on those that bring the frivolous suits.

I disagree with this. I place the blame on the lawyers and the system that allows these cases to be heard when they are blatantly frivolous.

“The ruling makes sense, it's practice will be used as a weapon.”

This is what scares me. The LGBTUV movement continues to weaponize and attack. Are they held back in any way now in America? I can’t think of any ways they are. What is there left to attack now, except those persons who don’t subscribe to their beliefs?

It's already near impossible to fire someone of a protected group in a corporate setting. You need years of poor performance reviews, poor stakeholder input, documented examples of incompetence. It takes years

This is a gross exaggeration

Why? Men have been a protected class for 50 years, and I have yet to have one be my waiter at Hooters or Twin Peaks.

Right disposition of the case, wrong reasoning.

Should have been a plain old sex discrimination case. Aimee was fired for being female - "Bob" was a perfectly acceptable employee and Aimee wasn't, and there's only one difference between them.

Nah. Just claim you're a straight white alcoholic and demand rehab. Free 30 day vacation.

The success rate of those cases has to be pretty low though.

That's why you always have a paper trail of their piss poor performance.
And document every damn thing from when they get to work and when they leave, incompetence, inability to follow company policy to the point where they are a liability to the business.

Folks better know who they're hiring, do through background checks and vet their social media accounts - perform random drug tests.

@AnnCoulter

After today's "trans rights" decision from the Supreme Court, the only employees you can fire without getting a lawsuit are: young, healthy, heterosexual cis white American men (or illegal aliens, who won't sue).

Choose carefully in making your hiring decisions!
