If it’s illegal to fire someone for being black or Jewish, I don’t see why it should be legal to fire someone for being gay. Granted I am a libertarian where I think Title VII should be revoked and if any business is actually racist or sexist, then I’ll just go shop elsewhere. But I don’t see why sex should be a protected class and sexuality shouldn’t be as well.

With this being said, now gays are 100% equal in the eyes of the law, so the gay lobby can now shut the frick up.

I don't either but now the problem is if you fire a gay person because of poor performance you will potentially have to prove that was the real reason in court. It's just more of the Government interfering with a private business.

I'm a small government guy as well but it seems like that would be difficult to prove. I mean, any non white male on the planet that got fired could claim discrimination I suppose. The success rate of those cases has to be pretty low though.

Well I don't know anyone who does but I can see lots of lawsuits in the future for anyone who is fired that is gay.

And they're the ones likely to kick up a fuss about it.

It's already near impossible to fire someone of a protected group in a corporate setting. You need years of poor performance reviews, poor stakeholder input, documented examples of incompetence. It takes years.

That's why you always have a paper trail of their piss poor performance.

Even if this is the case, it still costs a lot to litigate and prove it. A lot of attorneys know this and will just sue to get a settlement. It already happens with other protected classes as it is.

Plus, it's just more burden on HR departments now too. No matter how you look at it, this is an added cost for businesses.

Most companies settle these things before they even go to court.

But in the rare event it actually goes to court, a company that has dotted all their i's and crossed all their t's usually has little to worry about.

Old white males. Pretty much walking around with target on back at layoff time.

all of this

if we are going to have protected classes, it seems obvious that sexuality would be part of that, so this is just an obvious extension of an already established law

I'm not in favor of any protected classes, despite what the OT likes to believe

Discrimination laws are an overreach of government. Private companies should be allowed to hire who they want. This just opens the door for more frivolous lawsuits against companies who fire LGBT employees for cause.

Federal Government needs to get out of social engineering and focus on the original intent: National defense, economy, infrastructure.

One way to fight frivolous lawsuits is to actually fight them in court and win against them. Settling out of court to avoid the fight helps perpetuate the problem.

Has nothing to do with the law, unfortunately our trash judicial branch loves to take their personal “should be” and create law out of thin air.

That's only beneficial if the loser is required to pay

Also is typically more expensive in the long term than settling.
