It can be, but settling them out of court gives the lawyers plenty of motivation to file more and more suits, whether they have merit or not.
For businesses, it can be a damned if you do, damned if you don't scenario. My point was more that there are two factors contributing to the frivolous lawsuit "problem." A lot of lawyers are just looking for a cheap payday knowing most companies would rather just settle out of court and move on.

It will be tough to prove this either way in lawsuits.
Be careful what you write or type. The stuff that can be saved and used against you. Without any tangible proof that someone was fired for their sexual orientation, they'll have a hard time making up that reason.
Obviously don't fire someone just because of that either, that's fricked up. But if you do fire with cause, it's smart to not have ever said anything ever about their sexual orientation, etc.

This asinine take tells me you didn't read any of the dissents. None of the justices had a problem with Title VII covering gay, lesbian, and transgender; their problem with the decision was that they felt it wasn't their call to make. It was Congress's bailiwick and they felt the decision legislated from the bench, something they adamantly oppose.

Sure, but the business is much less likely to fight the long drawn out, expensive, good fight over a scenario they will likely only face 1 time.
The lawyers just move on to the next one.

I was the very 1st person in my company laid off back in March (I know this from looking at the notary ledger log for the NDA paperwork when I signed it). I also happen to be transgender.
My boss treated me very different from my other coworkers. I busted my butt because I didn't want to give anyone a reason that I was a substandard employee because of me being trans. I wanted to set an example that we were just like everyone else and didn't need special considerations or any bs like that. But the straw that broke my morale was being written up for an asinine reason out of my control (having a written warning was unheard of), when my other two coworkers made massive mistakes and received a "don't do that again" talking to. My coworkers were in disbelief that I was being written up after receiving glowing weekly reviews the month prior. My boss was also a devout Jevovah's witness in a company that was very conservative. Do I believe I was being treated unfairly, yes, in my opinion. Could I prove it? Nope, not at all. The company was downsizing, but I'm sure the truth is somewhere in the middle.
I wrote everything down and logged all the weirdness. In the end, being laid off from that company was a blessing in disguise as I was miserable from the commute/quality of life, and position. It wasn't worth fighting; relieved I no longer had to work there. But it still stings as I worked hard in that position.
I'm trying to bounce back as I'm still looking for work; most companies in this area are still in long-term hiring freezes. Finding work for folks like me is difficult. It's disheartening.
Put one foot in front of the other every day and keep trying.

Business owners/managers/etc. are scared to fire anyone of color even with just cause because of the threat of lawsuits and/or bad press.
That makes them less likely to hire those people. People don't like to admit that, but it is true. Even if it is a tiny, tiny chance that happens, they'd rather avoid it altogether.
It's a negative impact of laws like this.
