Mother in law was in a similar situation. She was in debt to her eyeballs. There was no estate to be divided no secession done. When the bill collectors started calling, I told them to pound sand or I could fax them a death certificate. I wasn't liable for her debt. Her daughter nor her son was either. She was from La, but died in Alabama. She had already lost her house/land to hurricanes and bad insurance deals. She literally had nothing.

This is the plan an elderly friend of mine is going with. He isn't married anymore and is estranged from his one adult offspring, so he's maxing out every cc he has as a final F-U to the banks.

It’s borrowing not stealing. Yiu just not paying it back b/c your dead. No different than dying before your house is paid off.

A slight variation on this topic: A girl I worked with committed suicide a few years ago. She was single, homely, introverted and stuck in a crappy job, so it's a sad story. But here's what puzzled me. She worked 40 hours all that week, wrestling Excel spreadsheets and organizing stuff for her a-hole boss, then went home late on Friday, paid all of her bills and just killed herself.

I know we can never wrap our heads around suicide but it just strikes me as so weird that she did all of this unpleasant stuff right before killing herself instead of drastically altering her life in some way first. If I ever go that route there will be signs...lots of signs that I am coming unglued as a responsible member of society. I'm going to quit my job, tell my boss to go f himself, liquidate my accounts, max out the CCs, knock off some bucket list items and let it roll in Vegas or Thailand or some shite before I self-depart.

Yes and conspiracy to commit it

What is the actual fraud? If the company gives you credit card following a truthful application there is no fraud. Unless the person is asked on the application do you have a terminal diagnosis how did they commit fraud?

The house is the bank's collateral. Very different.

A dear friend killed herself not long ago. Married with grown kids. Stunned us. She did similar creating a spreadsheet for her husband to try and pick up the pieces. Suicidally depressed people are not rational.

It's kinda what people are doing today.
Maxing out "credit" to live like a baller.

Absolutely no intention of paying it all back.

If I tell you I’m borrowing your lawnmower and I absolutely never had any intention of returning it….did I borrow your mower or steal it?

You would need to get a divorce before any debt starts to rack up
And by materials and services that cannot be repossessed.
Any loans would need to be washed small incriminate to a 3rd party or keep as cash do not deposit in a bank. It can be done but you need to be creative.
Have you pay for the plane tickets and hotels w a cc and have him pay you the cash so the bank or mis cc co can't come after you

They would come after your assets if you have anything to leave to your heirs.

As long as he did lie on any of the applications I wouldn't this it is fraudulent.

The application is irrelevant. What’s relevant is that when you get any kind of loan (credit card, car loan, structured commercial real estate financing, whatever), you sign a loan agreement. This implies that you intend to pay the money back.

If you are planning to default from jump, you have, in fact, lied.

Good grief, if that's what you're doing when you're terminal, damn...

( I know you were just giving examples)

I would find a quiet place and ask God what I could do for Him with my time remaining.

Need to get divorced before racking up community debt

Had the CPA that did my taxes for years tell me way back, "no one does it, but it would be in your best interest if you divorced"...."just do it and then live together."
LSS, he explained in detail how this would work $$$$, but we never did it.

No, they'd just come after my wife and kids over it. Sorry, I am not going to burden them with that.
