They're advertising the nominal size, that it's cut to green at the mill. It shrinks to a set measurement when dries. They're not just making it up as they go along and anything close to 4" will fly, it's very consistent, and is listed as such on the actual dimensions of the product. This lawsuit is going to be thrown out pretty quickly.

Haven't been to HD lately, but I know Lowes has the actual sizes printed on the price card on the lumber rack.

I agree.

I also want to verify these idiots were
1.) doing a home improvement job that does not require a permit. In the Chicago area I know they are tougher on permits than in the South.

2.) These people were not idiots the lawfirm hired to do this.

3) These people are not wearing the special Northeast Chicago helmet with spinner on top that lets people know they are special.

It's a true 2x4 fresh off the log but once the mills finish it up, it's obviously smaller in size. Planing, drying, etc

ETA: Lowes had to pay out a few million for this same reason a few years ago which is why they probably have it printed on each piece now

I hope they provide some 4x4's that haven't been surfaced and you get a splinter. It would actually be cheaper for the mills to not surface the sides but then we'd have a bunch of pussies suing because they got a booboo.

The shite you buy in HD/Lowes/Most lumber yards are S4S, if you want a true 4x4, you'll need to find rough cut.
