I remember the first time my wife decided to do a home improvement project and I tried to explain this to her. She was convinced I didn't know how to read a measuring tape, so I took her to HD and grabbed a tape measure and let her wonder around measuring everything. 15 minutes later all I get is an "Oh"
In regards to the Lowes' settlement, I think there was more to the fact that the lumber wasn't a true 2"*4"; I recall reading something that their lumber was smaller than the industry standard (may have even been as much as 1/8") which lead the experts to believe that they didn't start w/ true 2*4s. In other words, the issue was instead of having 1 1/2", it was coming out as 1 1/4" or 1 3/8".
Don't know where I read it, just know after I did I stopped buying building products form them.

This is common knowledge for a lot of people, but do you think the average person knows the actual dimensions of a 4x4?
According to a friend who use to manage a hardware store, it is amazing what the average person does not know, when it comes to just about anything that can be purchased at a hardware store, however; I would think that most people who are going by a 4x4 would know this.
With that said, Home Depot is advertising as it is so customers who think otherwise are assuming. Which is the argument I would think HD would make.. Maybe?

I worked at Lowe's in the flooring department, a special kind of idiot came into the flooring department one and wanted to price out some hardwood flooring for their movable home. She picked out the flooring she wanted but the price was out of their ball park. Then the idiot asked me to price the floor using 2x4x8 because it was the same thing. I begrudgingly worked up the quote and she ran to the manager stating that I was over charging her because I worked the dimensions up at 3.5" wide and not 4". So there are a lot of idiot that have no idea how lumber is measured. You would be surprised how many think they can wrap their house in as they call it "magnolium rug" since it says vinyl flooring and it has to be the same as vinyl siding.

Now, as a lumber yard owner we can get our hands on actual size lumber. It is more expensive and a special order. I keep some instock for 3 remodelers that specialize in working on older homes.

I realized that the lumber didn't measure to the listed specs the first time I purchased lumber. You know what I did? I shut my mouth, and acted like I already knew, so I didn't look like a pussy that knew nothing about construction.
Besides, you aren't buying wood for the volume, you are buying for the common size. As long as the pieces are consistent with each other, who the hell cares? It's not like you are going to go to the local lumber yard and they have the real deal 4x4s.
I'm going to go to McDonald's and sue them for my 1/4 pounder not weighing enough after it gets cooked.

Now that is false advertisement when they are selling 18" x 4' x 4'. "Cord" is a cubic measurement of 4' x 4' x 4' so 1/2 would be 2'x4'x4'. Now if they call it a "face cord"...then correct.

I said she lived in a movable home as she called it what do you expect, she thought a little sanding, a little stain and poly and she was golden. I have many stories about the idiots I dealt with at Lowe's and some who were general contractors.

OK, lets pretend for a second that you dont know this. What is your reaction? Do you go back to the store ask for assistance then do a little research? No. You call a lawyer and go to court because what ever you are building is not going to be dead nuts. Now considering you dont know how lumber is measured, I cant imagine you are doing too big of a complex home improvement project

This is either fake or won't get past summary judgment.
In law school we read a case where a builder ordered some 2x4s and the lumber company supplied boards that measured actual 2 inches by 4 inches. The builder sued for breach of contract and won.
