There should be some sort of appellate process. Should you appeal and lose, you'll be fined. I'm not sure about your particular state's law, but if you don't pay the fine and should you not comply with their regulations, they can place a lien on your home or even institute foreclosure proceedings.

Some HOA's are voluntary.
Is it a true HOA or is it an Association?
A similar thing happened in my 'hood. They wanted to put up speed bumps and only 30% of the 'hood was in agreement. So the 30% raised their own money to put in the speedbumps with no financial assistance from the Association.

You should have a survey from the neighborhood about what is your property and isn’t as well as where fences are acceptable. If you chose to ignore those covenants you can be fined and have a lien put on your house. Essentially you are claiming property that is not yours.
Don’t be a dick. Move the fence. If you don’t like the HOA, move.
If others are violating the covenants, bring this to the attention of the HOA board for a variance possibly.

I cannot speak every HOA, but some most certainly can foreclose if there is a lein for unpaid fines/dues.

They can seize your home/property. You signed that agreement when you purchased your home. They suck but my advice to you is to follow their damn rules before they take your home.
