Dude, I have more experience with this than I’d care to admit. A few key things I’ve learned and I’ve just went through this process the last 2 weeks as I’m joining a new company Monday.

1. Always be honest when asked. They may find out and if they do, you want to have been honest. I’ve had a job pulled for lying and not being honest before. They said they would have kept me but I lied about one thing. Kinda forgot, actually.
2. They probably won’t pull the offer with just an arrest but they know it now and may want updates. It’s a misdemeanor, that’s huge in your favor. You’re not convicted, that’s huge in your favor. The recruiter said you’d be alright, that’s huge in your favor.

Things look on your side, settle down.

This. This is what I did. You have to get that green light before you quit your current employer. But he wasn’t working so that’s a bit different story.

It kinda depends the level off background check but this is just an accusation at this point. I don’t know if I would have told them either about that but honestly is usually the best policy. But yes, usually the question is specifically about convictions.

I've been on the hiring side of it and I'll say this. They are very concerned that the case is still pending. If the case was closed, it likely wouldn't be an issue, but that depends on the company. Being that there is still a court case, their concern is investing in a new hire that could potentially need time off for court and/or jail.

I'll also say that if the company really wants you, they'll overlook things. I watched as we hired a guy with a felony rape on his record because the hiring manager wanted him so badly. If you weren't a home run hire, but more a warm body hire, these things will absolutely derail the offer.

Though he claims to have told other companies he was no longer going to work the interview process with them.

He should be doing those interviews still.

I agree, but that’s easier said than done when you’re already working and trying to hide job interviews. Once you get that offer, you feel like you have a hundred $100 bill in your pocket and it’s hard to get motivated for an interview. There are only so many dentist appts that you can take from your current job.

So I have never failed a background check but some places are notorious for taking a long time to process request. I have had people I have hired take 2-3 weeks to come back clean. After hurricane laura....seen some take over a month.


Years ago, I have personally also had a job pulled while waiting for background to come back, so my policy is....I do not have the job until everything comes back and it's official.

Every form I’ve seen asks about convictions not allegations. If you told them voluntarily that’s just dumb.
