There are a bunch of reasons why auto rates in Louisiana are bad besides the tort system. Think of how many poor people there are driving piece of shite cars in Louisiana. Also think of how many of those people have insurance. Not many.
Not to mention our road system is absolute shite.
I do agree with the advertising aspect, though. The auto claim mills advertising campaigns have led every ignorant poor person who gets in a wreck to think if they get in a wreck, it's an automatic six figure settlement. What Morris Bart and Gordon forget to mention is that those huge settlements they get are for clients with an absolute shite ton in medical bills who were severely injured.
Not to mention our road system is absolute shite.

If it is in the police report what case does he have. I had one that ran a light, hit me, but didn't want to claim she was at fault even though she was cited and put in the wrong with witnesses. If it is in the police report and he is not in the wrong than even Spencer Callahan can't do shite.

A 16 year old girl hit me head on one afternoon. We were both doing about 50 mph. It was her 3rd wreck that was her fault and her family sued me because the Troopers wrote the report wrong.

Your insurance is to cover your liability to others and is based upon your driving history and other factors. Why would an insurance company pay incur liability of a third party against you?

They can sue, but they can't recover the first $25K in property damage and the first $15K in bodily injury. If they were uninsured, no way their vehicle was valued at over $25K, so they get nothing. And they would have to be really injured badly for any attorney to absorb the first $15K of their bodily injury damages. There ain't no attorney that's gonna take their case.
