If any of my sons did this, I would be very upset about losing my son. But I would understand why he was shot and not pursue anything against the shooter

According to the story, the kids fired first. That takes away any doubt in my mind what they had on their mind to do. Either way, anyone trying to kick in my door at 4 AM will be greeted with lead, and lots of it.
Firing first, or even being armed or not, is not germane. You have not duty to retreat, and if you feel that your life is in danger, you can defend yourself with lethal means.

Someone kicks your door in, you have every right to assume that they mean you harm, and you have the law on your side if you choose to deescalate the situation with extreme prejudice.

Criminal standard of conduct =/= civil standard.

It's bullshite, but that doesn't mean that it won't proceed in a civil court.

See this is different than someone pulling up to the wrong driveway and you shooting them as they drive away.

Or stabbing a kid at a track meet because you were in the wrong tent area.

Homeowner should definitely counter-sue the parents
Yep. The problem with our civil law is that anyone can sue for anything. It can be the most ridiculous case ever and not last 10 seconds when it finally gets put in front of a judge, but the defendant still has to spend time and money defending themselves from bullshite lawsuits. We need "loser pays" tort reform. That would most definitely cut down on the amount of lawsuits filed over frivolous reasons.

TN has a law that gives civil immunity to anyone in a justified self-defense scenario. Should be a federal law.

You shouldn’t be able to sue for damages when you are injured or killed in the commission of a crime.

Especially an armed home invasion or other violent crime.

How does one find any lawyer willing to take that case? Are they just hoping for an insurance settlement as a quick cash grab? Or is pro-bono work or something?

Didn't click the link but feel it's fairly safe to assume "Is it them again Yogi"?

And the answer is "It's them again Boo Boo".

He is going to have to pay money for a damn lawyer to defend him in this bullshite suit. Beyond ridiculous. I would definitely file a counter suit to recoup legal fees and “emotional damage”.

This happened in 2019. IDK why it's being posted now except for rage bait.
