The verbiage should both reflect that difference as well as not dilute the absolute soul crushing experience that a real rape results in.
Not all rape charges are equal. There are varying degrees (first, 2nd, 3rd, etc.)

Same situation? Yes.
When I was in high school it wasn't uncommon for younger girls to chase older boys. It WAS uncommon for older girls to play around with younger boys though.
Also, I already admitted to a similar age gap between my husband and myself and that we started young.

I think nearly every state has laws that make an exception if they teens are a year or two apart in age.

We know what the law says, but this is a very different situation from a teacher/coach banging a kid. This appears to be a relationship that many of us likely have a larger age gap with our spouse. This one does not have that power dynamic, at least with the info I'm seeing.

The laws I have seen make exceptions for when the age difference is a year or two or less.
So, 18 on 16, or 19 on 17 might be legal in some jurisdictions.

Well, charges have been filed, so apparently the DA in Utah feels like he can make a case.
My guess is she pleads down to lesser charges, has to register as a sex offender, and gets put on probation with no jail time.

Obviously he can make a case. The law is the law. I really just can't get on board with calling this rape. I had a gf in high school that lied to me about her age, and it could have gotten me a statutory rape charge if her parents had wanted to pursue it. Having sex offender status for something like that shouldn't happen IMO. Our gap wasn't anywhere near as big as this one, but still.

It has been successfully argued in court that the intent of these laws was never to regulate consensual relationships between high school students. Even those a couple of years apart.

I have a similar experience.
When I was 16, I began to be repeatedly abused by a 21 year old. It went on for years.

If a 19 year old guy has sex with a 14 year old girl he’s going to jail and is a sex offender. There’s no difference here.
