That's what I mean, obviously.

Anyone else think the quick manslaughter charge for the recent police shooting that is pretty clearly manslaughter was to influence the jury in coming back with guilty for manslaughter since the state knows murder is a long shot?

Chick on court TV just brought this up.

Nailed it

being a cop, and a first time offender I assume, if this weren't the trial of the century so far and not a high profile case, what would a typical sentence be for a conviction on any or all of those?

The slide they referenced said that Floyd's carboxyhemoglobin could have increased by 10-18% (not TO 10-18%).

Even if his number was 2, then a 10-18% increase would only be 2.36 max which is still in the normal range. There really isn't a need for this rebuttal witness.

Carboxyhemoglobin is reported in percentage of hemoglobin in the blood bound by CO. He meant an increase of 10-18% in the amount of total hemoglobin in the blood bound by CO. Carboxyhemoglobin is not measured more precisely than a whole number and it would never be necessary anyway as changes that small would be meaningless.

I believe they have to find him innocent or guilty based on the charge he was accused of?

If all 12 jurors aren't ultimately able to come to unanimous agreement on any of the available verdicts or alternatively a unanimous not guilty verdict, the result would be a mistrial and the state would retry the entire thing, in due course. New jury selection, etc.

He didn't "plead the Fifth." The defense simply decided not to call him.

isn't a general strategy to try to not have the defendant testify in a case like this?

I bet the jury won’t reach a verdict on the murder charges, but get tired of deliberating and convict on manslaughter. It still seems weird to me that states are allowed to throw up multiple charges of varying degrees like that, but I also don’t know Jack about the law. It just feels like they can overcharge hoping to hit the jackpot, but if they fail at that they get a few more opportunities to convict.

Yes. But it has to be on the record.

ETA...and they’re generally bokinized to demonstrate that they aren’t being forced to not testify

in a weird way... I kinda wish it was...

like a football instant replay review... confirmed, upheld, or overruled where the call on the field is always innocent (since the burden of proof is on the prosecution to prove beyond a reasonable doubt the accused did the crime)

confirmed is essentially innocent... there's enough evidence to prove that not only can this person's freedom not be taken away... but to prove that the person actually did NOT perpetrate the crime

upheld is essentially not guilty... it's not definitive that the accused didn't perpetrate the alleged crime... but the prosecution didn't hit the burden of beyond a reasonable doubt

overruled is essentially a guilty verdict... evidence is definitive and you're guilty and you're going to the pokey

Lol this plead the fifth is going to be the media spin headline today.

CHAUVIN PLEADS FIFTH TO AVOID PROSECUTION QUESTIONS

Even though it’s more than common for the defendant not to testify

He has to plead the Fifth and the judge must make sure he is doing this on his own free will and that he has the right to testify on his own behalf if he wishes. Chauvin agreed that it was his decision and no one threatened or coerced him into it
