The weather record shows the temp was just above freezing at the time she was struck?

So Madison was just let out in almost freezing cold temps?

Literally nobody is downvoting because we think it’s a good idea to get blackout drunk. It’s such a “no shite” pointing out the obvious sort of take. We are downvoting because it has no bearing on this:

Let out is being generous. Thrown/pushed out of the car like trash is the more appropriate terminology that should be used to describe the incident.

Is that actually confirmed?

The defense lawyer said consent was filmed.

The judge said what was filmed was the rapists laughing at an obviously intoxicated victim.

I can't upvote this enough. You see it in every gruesome crime thread. We get it. Everyone wants the perp to pay. What's with the contest to see who can come up with the most creative way to break the 8th amendment.

I’ve seen speculation about an argument here, but I have not seen any reports of an argument in the news articles or the affidavits. Maybe I missed them.

My point was that the lawyer’s statement opens them up to more speculation/scrutiny from the public. It seems like he was trying to refute the idea that they simply dropped her off, by pointing out that she demanded to get out of the vehicle. I think that’s a miscalculation, but that’s just my opinion.

Ultimately it’ll all come out at trial anyway (assuming at least one of them goes to trial) so it probably doesn’t matter.

yes. my guess is she said something to the effect of "yes" but was so clearly beyond the realm of being able to consent to anything (to a reasonable person). she was certainly an absolute mess in that car.

The defense lawyer handed over video he said would prove the sex was consensual. It was video (according to one report) made after the sex acts. Madison was clearly out of it and the defendants laughed callously, according to the judge.

Now, does video of the actual rape exist?

I think these guys did video it and it is on a phone or in an iCloud somewhere.

I also don't think it was their first rodeo doing this. Perhaps another victim will come forward.

Someone in the thread said the 28 y.o. was there at Reggie's to sell drugs. FWIW.

I don't understand what exactly this attorney was thinking or why he made public statements knowing her BAC was on the extreme side. Already setting up ineffective counsel for appeal?

If he doesn't, I will. Everyone in their right mind has talked to their kids about this story. We have personally had in depth conversations about drinking too much, what consent truly means, and looking out for your friends in social situations.

HOWEVER, to repeatedly victim-blame that somehow Madison has some personal responsibility in how her life ended is a stupid take. And honestly, it's just mean. She's dead. She can't tell you what happened that night or take it back. She was likely coerced into the car, as even the rapists said she was trying to get in another car. The 17 year old "hugging and walking" with her could have just been leading her to the car.

Please shut up with this.

And ETA: Y'all stop blaming her friends, as well. It's like none of you have ever been to a bar before. You don't walk around holding hands.

In my own personal view, that would be gross malpractice.

This will go to the First Circuit. I doubt the Supreme Court would touch it. And the chances of either saying that the defendant gets a new trial because the lawyer made terrible choices is very, very low.

And then you would just get tried again.

Ehh I wouldn’t take that as gospel.

Journalism ain’t what it used to be, and there are a lot of outlets pretty far from Baton Rouge covering this at the moment. Wouldn’t surprise me at all if a video of her in the truck got misreported as a video “of the rape.”

Such a video may be out there, but I think there would be a lot more reporting on it if the media knew it existed.

Lawyer was trying to frame the case in the minds of the public - or a certain subset group of the public.

"Drunk white girl. Poor black boys charged." Go read the WAFB comments. Get a couple with that mindset on the jury = not guilty.

Daily Mail just updated their story. True crime podcasts and Dateline NBC likely on the way to BR now.
