I could see that happening. Washington especially with the other charges he's facing not likely to go to trial in this one.
'Judge Holden' suggested these upgraded charges make the 17 y.o. more likely to flip. Perhaps testify against the two in the front seat. Not sure what they have to say that would help the prosecution that they already didn't say in the police interviews.
Btw, there's a video worth watching on YouTube: "Why you should NEVER talk to police" done by a lawyer and this case is another example of people 'explaining their way out of trouble' only to hand police what they need.

There's also the fact this defendant is represented by the public defender's office. These offices have good lawyers but they are overloaded with far too many cases. In some cities it has become a Constitutional issue. The First Degree charge means the "let's go to trial and roll the dice" is rolling the dice with life in prison if they lose.
With that fear it becomes "Let's make a deal" and most defendants will plead guilty to a lesser charge or charges to avoid life.
But Judge can speak to all that better.
Judge, any reason they started with this defendant? Any guess which defendant will be next up with the grand jury?

If it's Reggie's, they raped her around the corner (according to affidavit) and then brought her back to Reggie's?
My theory: they dump her out of the car. She looks and realize she has no phone. She waved them down, apologizes to Casen and she gets back in the vehicle. This was not the 'exit the vehicle - we drive off' video.
It was (and maybe I've been around too many sloppy drunks) the "dump out of vehicle when aggravated only to let them back in and the drunk babysitting continues" moment.

They got out and switched (according to their story in the Affidavit) but this was getting out to let Madison exit, "Get out! Get out!"
I think that video may have been made in one place. Then she realized she didn't have a phone to Uber. So they let her back in the vehicle.
But that's why figuring out what's in that brief image matters.
More lies the perps tell = less believable when they say anything else.
That looks like a sideways street sign (speed limit?) as you see the truck drive by. The building across the street has a white top. I don't think anything within two miles down Burbank has that.
Again, how did Madison get to where she was killed?
The closer in time and location her drop off was to where she was run over = more likely it would be negligent homicide or even manslaughter. That's based on the 'legal eagle' commentary on here.

Washington had the phone making the video the defense lawyers handed over.
Madison - blurred out and go re-watch - was pulling up her pants as she exited the vehicle.
So we have this felony in the video the defense lawyers shared with the world.
They gave Nakamoto proof of a felony, which he then put in the news story.

I wonder which defendant is up next?

Before there was The Allman Brothers Band, Duane Allman was trying to attract any kind of attention and make a name for himself. The music business is hard you know. Though immortalized now as one of the greatest guitarist of all time, it was Gregg who was more sought out in the record business in the early days. So Duane made ends meet by being a session guitarist in studios while he decided what his next move would be.
It was in November of 1968, when Wilson Pickett - already a star - showed up at Rick Halls Fame Studio in Muscle Shoals, AL wanting to record, but with no material or ideas. Duane, who was working for Rick but was not even the main, lead session guitarist, suggested that they cut "Hey Jude", which Rick thought was "the most preposterous thing" he had ever heard and Wilson agreed they would NOT do it. The Beatles had just recently released it and it was climbing the charts. But Duane somehow convinced them both it was a good idea because it "was" a Beatles song and it "would" be Number 1. And, as you hear, it was a GREAT idea. This song sparked the beginning of Duane's future nickname and the formation of ABB.
The story goes that Duane was already known as "Dog" because of his looks. As you might imagine, the hippie look that Duane sported was few and far between in late 1960's Alabama. When Wilson heard the way Duane played he started calling him "Sky Man". Not just for his "out of this world" playing but also for his "out of this world" state of mind he liked being in (recreational activities for those who still don't get it). From there the name somewhere morphed into "Skydog". Rick Hall was also so amazed that he phoned Jerry Wexler and put the phone up to the speakers on the playback so he could hear the song. Needless to say, he was also blown away by Duane's playing. And in Wilson's defense of this DA story, his vocals in this song are what they are in all his songs -- AWESOME.
Jerry Wexler was Wilson's main producer for Atlantic who wasn't able to be there and gave the reins to Hall. Wexler, along with Phil Walden, later in '69, started Capricorn Records in Macon, GA and we all know that story. Also, Phil Walden is also the man who introduced and brought in Jaimoe to play with Duane. They started jamming together before any of the other Brothers joined in.
Well anyway - this is for your listening pleasure and hope you enjoy it. If you want to know more of this story, I highly recommend pp. 80-88 of "Skydog: The Duane Allman Story" by Randy Poe. It is where this info came from and it is the best book ever if you are a Duane and/or ABB fan. And the Muscle Shoals Rhythm Section...thank you...you helped change the world and the music for the better.

WAFB updated their story and said NO kidnapping charges.
Upgrade was one count of 3rd degree rape and one count of 1st degree rape.
Plus, he's charged as an adult.
So the 17 y.o. is facing life for the 1st degree rape charge.
