Yes and no. In Texas, “murder” is the general equivalent to what you’d call “2nd degree murder” and “capital murder” would be what you’d call “first degree” elsewhere.
So the “murder” conviction in this case is the functional equivalent to a 2nd degree murder charge.

The key point in all of this is when she admitted on the stand she shot and intended to kill the man.
Murder in Texas:

I have asked black people many times on social media if a white cop can kill an unarmed black person without it being racism. Every person that has replied acts like it is the most ridiculous question they have ever heard.
