Can you still be charged with armed robbery if you use a fake gun? Seems like intent of the gun would trump it being fake.

As a cc holder, I wouldn't have shot in that situation.
He's probably going to lose a lot of money over this.

They just don't get it. The man had a right to protect himself from an armed criminal and that is what he did. Nothing to see here and no charges will be brought against the guy that killed that trash that attempted to rob the store.

Police and CCW are taught to stop the threat. Once the situation rises to deadly force and your gun is pulled your not thinking about how can I wound the threat but how can I stop it....end of story. If you don't want to get shot once or multiple times don't rob a fricking store.

That's a good point. Can't really judge it unless you were there.

I should say that in general I don't plan to shoot anyone solely to prevent a robbery unless it's in my house.

Sounds like the same case of no one taking responsibilities for their actions just like the brat in SC.

Somebody's gotta answer for it? That person was gunned down for trying to rob someone. He missed out on that chance, when he pulled his gun.

My point is, if the gun looks real then you are potentially saving the clerk's life or your own. For all you know the guy is going to kill the both of you to rob the place. I'm not waiting around to see if those are his intentions.

Here's the problem; you're assuming the armed robber will take the money & run....what if he doesn't? What if he turns on everyone so there are no witnesses?

Blame the parents for raising a shithead kid. Don't blame them for questioning the CC shooter. They are not thinking clearly due to the emotional trauma of the situation. In a few months, perhaps a year they will be able to accept that their son deserved his fate.


Had a classmate in 10th grade who decided to rob someone at a drive thru ATM one rainy night. He stood in front of the car pointing what looked like a 9mm pistol while his friend went alongside of the car demanding money. Turned out that their victim was an off-duty NYPD officer.

Classmate took 6 rounds to the center of his chest while his partner (another classmate) ran off.

The 9mm turned out to be a BB gun. Cop was quickly cleared during the investigation as the gun was almost an exact replica of a Beretta

...you assume that all circumstances lead to a simple snatch and grab. At any moment the perp could show his sadistic self or panic and selectively shoot people.

If a deadly weapon is produced and people are threatened, the safest approach is to neutralize the threat.
