You are overthinking this. If he was listening on the phone then it's not recording, of course she was playing on her phone because people are addicted to them. He was probably there in case you got crazy and that is his wife.

Nothing. He even asked her when she said what she did, "why would you say that to a kid".

Im not going to put specifics on here.

In the meeting she said when he asked her that she realized she went to far. Again, I get people have bad days but its zero tolerance with state law. This school has had many incidents and when teachers arent held accountable or get away, so do students. An apology was enough.

How old is your child and what did they do to get yelled at? If your kid was acting or has a history of acting up why pursue it any further? It sounds like he might have had it coming. She didn’t physically abuse him I’m assuming right..?

Yea, don’t tell us what your kid did but give us all the details about how awful the teacher is.

Yes. It's a public record.

ETA: the Freedom of Information Act is the Federal law. There is likely another state/local law that applies. Just tell them you want to make a public records request. Work fast for video however. The storage capacity of the nvr is likely only a few days.

FERPA is the applicable law, and again if not used as part of the student education, no law or policy was violated, then the request can be denied.

The video likely doesn’t have sound, and you will be responsible for the cost of redacting the video if it includes any students besides your own.

On a different note, many government offices that handle public concerns will post an employee nearby to intervene if needed. It’s not unreasonable to have a male nearby, and even if it’s her husband, you said yourself that the district is small and the supervisor was not available. Likely they could claim he was the only male available to standby for protection if needed.

Is this for certain? Using a personal phone while conducting business for the government can and does make that phone and it's contents subject to FOIA...I have had it happen and know others who have had it happen. It is pretty common for LEO phone's to be subject to FOIA requests. If he was there officially I would bet it would be...even if he claims he just happened to be there it might be up to a judge to determine if he was there by accident or there officially.

The issue is why would it matter? If the issue was resolved to satisfaction, what is the point of pursuing it further? It sounds like the matter was not resolved to your satisfaction. Understandable but if it was pursuing it further suggests you have had second thoughts and it wasn't resolved to your satisfaction. If this is the case it is a decision to make the effort to pursue it further. Unless there were some serious damages suffered the cost and effort of pursuing it are probably not worth it. Litigation is not only financially expensive it is also very mentally expensive...usually best to chalk it up to folks being assholes and get on with life, at least in my experience. I have watched folks destroy their lives over issues where they did indeed suffer significant damages only to find the court system worse than the initial damages.

Just a little hint here........you can't trust them. If it's public they're the govt, and you can't trust them. If it's private, you get a little more honesty, but at some point their lawyer makes them go turtle.

Same in La. As long as one party being recorded is aware of the recording, it's legal and admissible (at least it was when I took law back in college).

Maybe husband was there just to make sure his wife was ok and wasn't attacked by an angry parent. (Not saying you're in the wrong whatsoever, just thinking he was there to protect his wife if there was an escalation).

If it's a public school, can you do a public records request for camera footage? I have no idea.
