So what he is used the taser on the other cop? He literally just stole a taser from one cop. You don’t think if he got the other cop on the ground with the taser, he wouldn’t then take that officers gun? Because his actions are showing he would.

You forgot to add That he used that weapon. And yes, that requires deadly force. Because the cop cannot assume he will continue to flee once he has engaged. You cannot allow yourself to become incapacitated. He has his gun on him and if he is incapacitated, it becomes available to the perp. This has happened before, Lester. Running away means nothing if he’s engaging.

In a vacuum, you're probably right

But from a reasonable cop standard, who was just violently attacked by a guy and who sees a taser pointed at him, my condemnation has limits.

Being drunk and/or on drugs, violent, and unhinged, assaulting two officers, and running away with a potentially deadly weapon into an area where innocent bystanders have gathered, then pointing that weapon at the officers in an effort to evade arrest, will 100% of time result in the use of deadly force.

Chasing the perp creates a situation where it is your deadly sidearm vs a non lethal taser, that only becomes a 'lethal' threat as you close in on him.


Call for backup, check your partner that just got his taser pulled right from his hand (lol), regroup, get back in your car and then search for him.


A then face to face confrontation becomes more orderly, less impulsive & spontaneous (for both parties). If deadly force is then warranted, so be it.

So Yes. All of those are examples of serious bodily injury that an officer should not be expected to just accept as a consequence of being disarmed by an inebriated criminal with violent intentions.

None of this is protocol. And for good reason. You don’t need to search for someone you can see. Chances of finding him drop exponentially.
