And they will bide their time. No reason to jump on a wrongful termination until things settle down. It's way too soon for something like that.

If you meant officer, he'll make millions from a wrongful termination lawsuit.

If you use it too often, it loses it's luster. You have to be selective in when you use it for it to be effective, and you also have to follow up on your threats. If you say you're going to take the xbox, take the xbox. My wife does this and never follows through. Last night i told my kid i was going to take all his electronics away, he didn't listen, so i did. This morning he asks where's the xbox and nintendo switch. Well son, i told you i was going to take it if you kept acting like that, and you did. Next time you don't listen to me when i ask you to stop acting like that, i'll take it away for two days, and the next time, 3 days, and so on. Didn't yell one time.

You think the person running away from you with a non-lethal weapon is a threat?

They can't arrest him for DUI just b/c he was asleep in the drive thru and ran up the curb, even though we all know it's about a 99% chance he was under the influence, that's not how it works in court.
Yes they can in GA
“It surprises many drivers (especially those who pull over to "sleep it off") to learn that the DUI laws of most states also prohibit drivers from "operating" or being in "actual physical control" of a car while under the influence. In other words, you can get a DUI without actually driving.”

Is it a deadly threat is the more specific question.

CFR 1047.7 disagrees with you, Internet Guy.

To be fair, the Atlanta DA clarified just a few weeks earlier that tasers are legally classified as a deadly weapon in GA. This was stated after police used tasers on several students protesting.
Tasers are no longer considered non-lethal but rather less-lethal because they still have the potential to kill people with cardiac issues.

You think someone firing a taser at you is not?

No, it doesn’t,
Did you even read the statute?

The DA charging these cops said 2 weeks ago that a taser is considered a deadly weapon in the state of GA. Your boy Rayshard pointed and fired that deadly weapon at a cop after he violently took it from him. This is about as open and shut as cases get.

Does it?
quote:
(5) Apprehension. When deadly force reasonably appears to be necessary to apprehend or prevent the escape of a person reasonably believed to: (i) have committed an offense of the nature specified in paragraphs (a)(1) through (a)(4) 1 of this section; or (ii) be escaping by use of a weapon or explosive or who otherwise indicates that he or she poses a significant threat of death or serious bodily harm to the protective force officer or others unless apprehended without delay.

At no time was the officer in imminent danger of death or bodily harm since the suspect had a non-lethal weapon.
There was no serious offense presenting an imminent danger of death or serious bodily harm.
No nuclear weapons or nuclear materials involved.
Since none of a(1) through (4) applied to the suspect who was sleeping drunk in a parked car apply, deadly force in the apprehension of the suspect does qualify. Now if he pulled the officer's pistol, then we have a different story. However, he pulled a non-lethal weapon which by definition is a weapon that does not cause significant threat of death or serious bodily harm.
Sure, some courts have allowed significant leeway in the past, which was BS. That's why we have trials, but the laws as written certainly give enough guidance that I am correct here.

What is the threat, exactly that justifies the suspect being killed in the most cowardly way possible? The officer might get shocked? He deserves that at a minimum for allowing his tazer to be taken from him by a sleepy, drunk guy.

That's crazy. Thanks for the clarification.
