what are you talking about? He failed the field sobriety test....on camera.
All I was saying the way he was behaving the cops had every reason to believe that his health was in danger and he was a danger to others....calling EMS to check a person out doesnt mean they are going to automatically give him a DIU...he could have been having a medical emergency.

We are debating what "bombed" out of his mind means, which makes no difference here, and is what you are deflecting away from the point i was making, that police have to follow procedures before arresting someone for DUI.
I said "bombed" to me meant can't talk at all as in speech so slurred you can't understand anything, can't walk or stand up without help.
You're saying "bombed" means really shitfaced, and i agree. the guy was obviously wasted, and on more than alcohol. He was still capable of talking and having a conversation with the police, albeit like a really drunk person, and he was able to perform some of the field sobriety tests, failing them, but at least he was able to stand to do them. And he was obviously not too "bombed" to wrestle with two guys and run away.

I don't disagree
Maybe that's what they were going to do after they arrested him. EMS doesn't come to a scene unless they know there are no dangers, and police are the ones that determine the area is safe for them. How do you know they weren't going to call EMS after arresting him?

The cop cannot make the assumption that the perp will continue to run if that perp is using a weapon while fleeing.
Look up Vickie Wax. Guy punched her in the face knocking her out. Took her gun to shoot two other people and then shot her when he had the chance to flee even though she was incapacitated. Someone choosing to fight a cop, stealing the cops weapon, and then using that weapon on the cop is going to be met with lethal force and rightly so. Running away while using the weapon is completely irrelevant.
