The officers spent 40 minutes trying to be polite and calm with the guy that was obviously bombed out his mind.

They should have called EMS and had the guy checked out....on top of that they should have detained him as soon as he ran up on the curb....

So if Lester is saying it was poor policing.....maybe he's right in that sense

In a perfect world, what you said is what should be able to happen, but that's not the world we live in, b/c we have criminals and we have attorneys who will find loopholes to get those criminals off with as little as possible.

Cop should get off by the letter of the law.


Doesn't change the fact that the situation he put himself in was avoidable.

Handcuffed, detained, and arrested are extremely close. For instance, you are wrong in your definition of detained as well. He was already detained because he was technically being held for questioning. He wasn’t free to leave until the tests and questions were over.

Could be, but unlike some controversial interactions (Zimmerman, for example), the first several "bad acts" were by the perp.

If I meant cuffed and stuffed I would have said arrested.

I used detained because that’s what I meant.

And you don't understand that police have protocols they must follow before they arrest someone for DUI.

As i said, i don't disagree with what you think should have happened. Detained can still mean handcuffed, so again, all you're doing is deflecting from the point once again.

Let's say they did detain him after he ran up on the curb. Then what? they talk to him and realize he's under the influence. Are they supposed to take him out of the cuffs that they just used to detain him and perform field sobriety tests? Are they supposed to just let him go? They can't arrest him for DUI just b/c he was asleep in the drive thru and ran up the curb, even though we all know it's about a 99% chance he was under the influence, that's not how it works in court.

He was already detained when you said “he should have been detained.”

ETA: stopping someone for questioning and a FST is detainment.

I think it was bad policing caused by the events going on. It seemed like they were being overly careful on subduing the man, which is why he was able to get free imo. But with police being charged left and right now and the second you use force it gets thrown on the internet without the full story, I can imagine them now trying to CYA and it can affect the way you work. I think overly cautious policing leading to perps breaking free may cause incidents like this to become more common.

Driving while intoxicated. Resisting arrest. Taking the officers taser and then trying to use it point black at another officer? You think the man couldn’t have avoided doing any of those things?

ETA: Apologies. I guess Lester is still defending the drunk man trying to point a laser he stole from an officer at another officer.

And the “witnesses” stilled called it harassment. It’s a no win situation for cops.

Sure, but it should still not end up in death.

Running away with a non-deadly(inaccurate/unreliable) weapon doesn't exactly call for deadly force.
