yall just wait until Louisiana cops lose that inspection sticker money. We're gonna pay out of our asses and you won't be able to go to the grocery store without getting a ticket.

Removing qualified immunity and loser pays tort reform would go a long ways in fixing many of our civil and criminal judicial ills.

Field sobriety test should be outlawed it is a catch all so the officer can make an arrest regardless of breathalyzer.

Sue the frick out of the department and cops. They shouldn’t be able to just unilaterally charge with DUI without getting bloodwork back first. People who work in certain jobs will lose their livelihoods because a cop has a “suspicion”.

Add in civil asset forfeiture reform and that's the big trifecta of fixing a lot of wrongs that exist.

Even if you're sober:
Don't blow.
Don't perform a field sobriety test.
Shut the frick up.

despite the person driving the ATV blowing well under the legal limit. Prosecution is trying to argue he wasn’t under the limit two hours earlier

Nothing wrong with the prosecution arguing that. Person was drinking, someone was killed while they were driving and the bac lowered during the time it took to take the test.

We’d need to know the figures, actual time and clearance rate

True story:

Pulled over and accused of dui (since I had a prior)
Submitted to breathalyzer (.000)
Arrested anyway
Agreed to have blood drawn.
Spent all weekend in jail trying to get a bailsbond to get me out under the stipulation I pay him $1800 from a credit card in my property.
Get out on Monday, in debt.
Get fired for not showing up to work Monday morning.
Get a letter in the mail on Wednesday saying the blood test results came back and that all charges were dropped.

This is why you don’t do the field sobriety test. Once they start asking you to do tests, they have made up their mind they are arresting you. The test is just to give them evidence to use against you.

I don’t mind a night in jail that allows me to sue the arresting org and collect.

In Georgia, refusing the test itself is a factor in your arrest. They'll arrest you, anyway, and put you in jail for the night.

Happened to me. I was sober/DD. Get pulled over around 2 am. Pass the sobriety test, but cop is convinced I'm under influence. Go to station, blow, 0.02, which is below every legal limit in GA. Cop takes me to have my blood drawn for drugs. Results come back weeks later, and shows I'm completely sober.

Still get formally charged with DUI. State doesn't drop charges.

This is a legit problem.

I’ll never take a field sobriety test, give me breathalyzer and blood test every time

Field sobriety relies on officers training and experience, blood/breathalyzer isn’t subjective

I've never seen a single video where the cop says "Know what? You're good thanks for doing the field sobriety tests. Go on your way now"

I actually "passed" one back when I was 20, but turns out I had a bench warrant for an unpaid ticket so I ended up arrested anyway But no DUI charge or anything related to that stop.
