If they're on a bicycle and you're in a vehicle with the means to get away, there is no self defense angle.

All of the articles online right now say the exact same thing as the one OP linked. No mention of the shooter either being at large or having been arrested, which leads me to think the cops have probably interviewed the shooter already and there’s a possible self defense angle to it.

When you get out of your car with a firearm, approach somebody, then shoot them, nothing else matters. That's attempted homicide, and you belong in jail.

Not necessarily.

Driver could have had his weapon holstered on his person while he was driving. And if so, he’s not going to unholster and leave it in the car when he gets out. I still haven’t seen the reason why the driver got out. Maybe he got out for the purpose of threatening the biker and then would be guilty of a crime. But he also could have been getting out to check to make sure the biker wasn’t injured. If he got out to check on the biker and then the biker attacked, the driver would have the right to defend himself.

I don’t get the OTs opposition to runners and bikers. I’ll agree they can be annoying, but pass them and move on. One less car in my way.

The standard is reasonable fear of death or serious bodily harm. It gets tricky involving an unarmed person. You obviously can’t shoot someone for just bowing up to you, but if you’re armed and being attacked or about to be by an unarmed person, you’re not required to take a beat down first before defending yourself, but will go to the context and details of, and here, probably based solely on witness testimony of the parties. Tricky for sure.

i looked him up in assessor search. he seems to own a house near the trace which has a different mailing address for the property. there's another house under his name elsewhere in covington too. both are technically covington, not abita.
