That is a particularly funny quote, seeing as how homeowners and business owners are getting harassed by BLM nutjobs for calling the police on criminals, when the criminal dies after the police confrontation.

i've always read warning shots are not recommended. Not sure how it applies in this case.

There is a huge difference between shooting someone in your yard and shooting someone under your roof.

So what is it? If the intruder was in a shop or garage, that's breaking and entering, and the family's lawyer needs to be punished for harassing the home owner.

If I was the kid's parents I would be slightly angry with my son's friends too.

Yes, the ulitmate responsible party for your behavior is yourself. However I do believe that friends should look out for one another when drinks are involved. It might not be lawfully required but its just the right thing to do IMO.

If the "victim" came towards him after being warned not to, this is an open and shut case.

It's 100% reasonable to be concerned for your life in the middle of the night after finding someone trying to get into your home. Add to that the homeowner gave him an opportunity to leave, and this isn't even a discussion.

Well, there is also another plausible scenario - the kid was legitimately up to no good and the homeowner stumbled upon him.

That very well could be, but when someone fires a warning shot and the other person doesn't have a gun, 99% of the time, the person without the weapon quickly gets the hint and hauls arse away from the person shooting the warning shot. So either the dude was completely wasted/high or he was a complete imbecile. Either way, he put himself in a bad situation.

One thing they left out that to be honest could be very important. I found the kid's HUDL profile for football. He was 6' 228lbs. I would imagine he probably was closer to 240-250lbs now. That is not some small, drunk person. Homeowner doesn't know what substance kid is high on. We have all seen the videos of people on drugs not being phased by police Tasers. This lawyer is just trying to become the next Ben Crump.

When you wake up from a dead sleep and realize someone is trying to breaking into your house, instinct kicks in. You go outside with the gun, someone comes towards you, you fire a warning shot, they still keep coming towards you..

Its a lot easier to monday morning quarterback that situation. People have a right to protect their property. What you want him to do? Call the police? You don't know what can happen during the time you are waiting for the police and calling the police isn't a fix all solution.

It should be done when you have no other option left because depending on what officers show up, they could make things worse.

Tragic incident but the kid made the mistake, not the owner.
