Former LSU football coach Brian Kelly has requested that the school pay him his full buyout of nearly $54 million after firing him as negotiations continue between the two sides, according to documents obtained by The Advocate.
In a Nov. 5 letter sent to LSU athletic director Verge Ausberry and LSU Board of Supervisors member John Carmouche, attorneys representing Kelly said that the former head coach wants LSU to confirm in writing by 5 p.m. on Nov. 10 that the school will "fulfill its contractual obligation" to pay Kelly the "full liquidated damages."

LSU would like to reach a settlement, and the documents state that during the Oct. 26 meeting, Woodward said LSU wanted to enter negotiations to pay Kelly a lump-sum payment of $25 million instead of the full buyout. LSU offered “one or more accelerated payments,” documents say, and the elimination of mitigation or offset language should Kelly get another job in football.
Later that day, documents say, Cromer increased the offer to $30 million over two installments with the removal of mitigation or offset clauses. Kelly rejected the offers.

Kelly's attorneys argued in the letter that if LSU were to fire him for cause, it would have needed to do so in writing before his termination. Kelly would have then been given seven days to respond.
“LSU has not asserted at any time that Coach Kelly was terminated for cause, or that any potential justification for such a termination exists,” the letter states.
LSU has not put Kelly's termination in writing with negotiations ongoing, sources said, so it is continuing to pay him in monthly installments.

People will still defend Woodward for giving out this clown show contract. Kelly should and will receive the full amount.

Good post and great cliffs! I am SHOCKED that Kelly is being an arse about this. Hopefully they settle around $30MM

That tells me he intends to be retired.

Well he already rejected the $30 million offer so I have a feeling that’s not going to happen

If LSU wants to drag BK through the mud and air his dirty laundry they could probably get a reduced buyout but it’s a question of if you want to go through that.

You were fired "cause" you were lazy. There is your "cause",

Actually the opposite. He’s trying to get LSU’s settlement finalized to help his negotiations with schools.

Maybe. Also depends on if there’s any actual dirty laundry that they have proof of.

How does finalizing a settlement help his negotiations with other schools?

Look, I know Woodward made our bed and we have to sleep in it. That said isn't there a terrorist organization or Indian scam center we can give the money to so at least it's going to somebody more deserving and of higher moral character than BK?

Hey, LSU morons, thats what you get for not immediately taking action when he was found to be fricking someone other than his wife, who i believe was LSU related.

Why would Kelly leave money on the table if the liquidated damages are $54mm? He doesn’t need to play nice. LSU signed the contract and has to live with the consequences.

Screw it. Continue to pay the monthly installments for the next 6 years and let his new employment mitigate the buyout.
Kelly is stupid not to take a $30M lump sum and remove mitigation. He'll end up with less money in the long run.
LSU can budget the buy-out over the remaining contract term.
In the end, Kelly will end up getting another job and then they will settle on a sum like what happened with Miles.

It’s not Kelly’s fault the contract was retarded. He should take every penny owed to him.

They will go into actions to prove cause. That's why its not officially written. If he knows that does exist, he'll settle. That's how you'll know

Seems like that could be part of the negotiation. Knock some money off and he doesn’t need to keep looking for a job. Question is, how much is that worth?

Didn't Doucet report something about a reduced buyout due to something with the morality clause in BK's buyout? Maybe there is something there.

Based on Kelly’s email, I think it’s reasonable to believe they were working towards a settlement. But so much changed after
I think you can thank the idiot Governor for running his mouth and insinuating collusion w/ his agent and Woodward, then firing Woodward who I’m sure BK thought he’d be working with on the settlement

Right now he has no leverage. He’s owed $9.5M/yr from LSU. No school is going to pay him more than that.
