Guess contempt of court wasn't good enough for the judge. I would say something needs to happen to the judge for this overreach but it is in NY so he will probably be given a medal for his bravery.

quote:

NEW YORK (AP) - A woman lost her personal injury lawsuit after her lawyer refused to wear a mask in court and the judge threw out her case, which had been set for trial.

The New York Daily News reported Friday that Brooklyn Judge Lawrence Knipel tossed the case after attorney Howard Greenwald said he could not breathe wearing the mask in the newly reopened court.

“I want the record to reflect that I am speaking with great difficulty,” Greenwald, 68, told the judge. “I want to the record to reflect that I am sweating profusely from the effort.”

He said, “I just can’t do this,” according to the transcript.

“I don’t contest the rule,” he said. “I just am not physically able to comply with the rule to do my job as a lawyer.”

Knipel, who was hospitalized with COVID-19 last spring, insisted the lawyer comply with rules requiring masks in all state court buildings.

“Forget about my personal experience with COVID,” the judge told the newspaper. “We have over half a million dead in this country. We have protocols. The most important protocol is wearing a mask.”

The lawsuit focused on a 2017 car crash that fractured the woman’s leg.

Knipel told the newspaper the woman would have legal recourse to continue her litigation even though he dismissed the case.

I despise personal injury cases as much as the next guy but what good does it do to delay this woman's day in court?

Was that a little disingenuous of the judge to say that? Is he suggesting she has to appeal his dismissal or is he suggesting she has to sue her lawyer and allege he malpracticed?

So, the system allows personal injury cases, but one person can bypass that based on some retarded mask rule?
Sorry, but I'm tired of the mask mandates much worse than personal injury lawsuits.

Willing to bet that this was one of those “oh no, my back done hurt” cases that the lawyer didn’t want any part of.

Too bad this case wasn’t in Philly...I could recommend outstanding counsel there.

I really enjoy trucking over old ladies with their grandkids and them not being able to recover for their losses. Fun time

Lawyer might be trying to get another judge. These people exploit every single loop hole.

Oh no!!! .17% of the population is dead! Run! Hide! Wear a mask! Cower in fear!!!

Perspective is so sorely missing in this whole stupid episode.

Yes, over half a million is a large number, but in the grand scheme of things it is nothing. Not even HALF of one percent of the population has died with (not from, as we know the numbers are inflated) this virus.

My stance has not changed since very early on: once we knew which segments of the population were most at risk, then those people needed to be protected while the rest lived their lives.

This "sky is falling" mania wore out it welcome about a year ago.

Flatten the curve, my arse.

Agree with laws or not, they are what they are. As an attorney, you’d think he’d be aware of the laws and be more obligated than most to actually follow them.

I do have a bad taste in my mouth for personal injury lawsuit. My wife got into a fender bender with a Cadillac Escalade about a year ago, and their bumper was barely scratched. Two weeks later. we get a letter from her attorney suing us for $50,000. Geico insurance paid her $35,000 and of course our rates went way up. My wife even had a video of her walking around just fine after the crash looking at the small scratch on her back bumper, saying she was OK, all of the stuff. And yes, that Escalade had chrome rims.

Serious question. Could we use computers to replace judges?

Compliance with the state is a must.

There is no right to a speedy trial in civil court, only criminal.
