They can and they are. OBPD is enforcing it. They dragged someone off the beach this afternoon who thought he didn't need to follow the rules.

At Santa Rosa Beach currently. Today was first day this week that Public Beach Access was closed, but for beachfront homes/communities Private Beach Access was still available. Authorities told us that they could not kick us off beach but told us to stay out of water/wet sand as that is considered public. It was not crowded at all.

I'm in Phuket on the beach. Life is normal here and it's nice( wouldn't come here in normal times ) but being abroad now of course is precarious.

Walton County is using the mean high tide mark as their Erosion Control Barrier and somehow believe they have the authority to use it as the "public" beach zone. Yes they are threatening $500 fines if you get in the water even if you are on your private beach.
This sort of skirting around laws and making up ordinances to push agendas is complete BS.

We are at gulf shores and they are letting us sit on the beach, but back by the dunes. Everyone once in awhile, we will see someone from the condos nearby make a mad dash into the water and then sprint back before the police dune buggies get them.

The shoreline of a pond with zero outflow would qualify as truly private, most other shorelines would not meet this standard.
PS: I use the old axiom “Your right to swing your fist stops where my nose begins” in this instance. The potential risk in the face of the COVID-19 issue for First Responders with regard to having to deal with recreational beach and marine users is not worth the reward.

We have a home in Miramar. Neighbor texted today and said Walton PD tried to scare them off the beach. Once he told them he was a resident they moved on to the next group on the beach and tried the same thing.

I saw a video today in Brazil where they were discouraging beach visitors. They flew a helicopter along the shore and when they found people congregating, they lowered altitude so that sand blasted them and ruined their party.
I’m not advocating this, but I did think it was an ingenious solution to their cause.
