I'm not sure which law schools have been teaching that. Avoiding the "appearance of impropriety" comes from the code of JUDICIAL conduct, not the rules of legal ethics.

Lawyers have to avoid conflicts of interest, but are not tied to the same standard of avoiding the appearance of impropriety.

If I want to get opposing counsel removed from a case, I have to prove a direct conflict of interest (and I've been successful doing that a couple of times).

While it would make sense for prosecutors to be held to a higher standard in the interest of maintaining public trust, Georgia has no special rules for prosecutors.

Wade should be fired, and possibly prosecuted himself. Willis should be turned over to the State Ethics Commission, the new Prosecution Review Board, and possibly the State Bar.

But she and Wade cannot be removed from the case without showing a direct conflict of interest, and I'm just not sure a financial gain creates that conflict...otherwise a DA would never be able to hire a special prosecutor.

The primary attack has been that she is sleeping with another prosecutor. That isn’t something that I’ve ever seen justify a judge disqualifying an attorney in a case. It isn’t a conflict of interest vis-a-vis the client (the state). It’s just a claim that they are somehow depraved people.

Farking around isn’t a ground to disqualify an attorney.

But who knows anymore. It just seems unlikely.

All you had to do was watch the trial.

It was clear Willis, Wade, and others perjured themselves. It was clear the affair started prior to Wade’s hiring, probably in 2019.

Both should be criminally prosecuted. Both should be referred to the bar for disbarment.

Until low life scum like these people suffer real consequences for their actions, it will continue and our “justice “ system will never be seen as fair and objective.

I think he has too!! He will be viewed as a corrupt judge if he doesn't, just for the fact alone of how many Fulton County laws or regulations Fani broke by not disclosing the fact she was having an affair with Wade.

That would be in a different proceeding later. The only impact this had in the subject matter was hurting her credibility for her testimony. Any potential issues relating to perjury, ethical violations, etc. would bein their own proceeding down the road.

Going to be interesting to see how this works if they appeal.

If it is bad enough to kick one off, then some form of egregious act is then reasoned to have or could have existed. If so, then the argument is if it is a big enough issue to strike Wade inadvertently Willis is tainted as well..

And a this begs a question... if there was enough evidence to disqualify one of the two, why not both?

Obviously they were both equally guilty of lying and conflict of interest.
