“You cannot lease your home” was the verbal complaint I received. I then received a letter from the HOA declaring that leasing my home constituted a commercial contract, which is just flat out wrong and can be proven wrong by a simple google search.

Ok so Gordon Hayward and Paper whatever OP are the same person I guess?

I think they would be proven wrong in a court of law given that the HOA bylaws are very specific and even mention 6 months as a limit for what is acceptable.

If you like it, by all means.

I just have hard time grasping asking permission to paint my house or plant a tree or whatnot.

My neighbor has a giant wood carved eagle in their front yard. I imagine that wouldn't be HOA approved

You aren’t going to find much suburban land in Texas, Florida, Arizona, etc. that isn’t deed restricted and subject to an HOA.

Do the HOA C&Rs you signed when you bought the house explicitly state that homes cannot be made for lease?

the HOA, mortgage company , insurance company and county own your house. You just get to live there and pay the bills

while it specifically talks about "short term" rentals, it doesn't exclude long term rentals. gray area.

Not really a gray area at all. If only rentals of less than 6 months are considered "commercial," then rentals of more than 6 months must not be.

Short-term rentals of less than six months are specifically designated as commercial use and are prohibited.

why shouldn't someone be allowed to paint their house fluorescent pink?

The idea that just because you own something you should be allowed to do whatever you want with it is a very naive concept.

No and even the amended bylaws mentioned previously do not state specifically that I cannot lease my home. The bylaws were reviewed by a real estate attorney prior to listing. I told the HOA president that if he steps foot on the property or harasses my tenant that I'll contact the proper authorities.

you can chose not to live there.

i mean, are you insinuating that you live a life without rules? do you drive? you chose to follow the rules
do you go to an lsu game or sporting event? you chose to follow the rules.

you can not follow the rules in those cases and get into trouble. Or you can not drive and not go to games for example.

i'm fine with the rules set by the hoa i decided to join. they align with my values and the way i live. if i didn't, i could chose to live somewhere else.

I don’t think you understand. The document was reviewed by a real estate lawyer who determined I was within my legal right to lease my property. I’m not sure what acumen you think you’ve attained that somehow exceeds that of the lawyer but it appears you’re in over your head. The comment you made in your letter stating a 12 month lease constituted a commercial contract tells me you have no idea what you’re talking about. You continue to grandstand as some bastion of justice while harassing a home owner within his legal rights and trying to evict a single mother of three (which you cannot do as it is my home). The tenant was vetted thoroughly; et al. background check, income and credit checks. This whole situation makes me not only question your intelligence but also makes you look like a huge jerk. Please exercise your legal right to contact an attorney. I assure you he will tell you the same thing. Not a single line in the bylaws states that I can’t continue as I am. I had a newborn a couple weeks ago and only moved to work and accommodate raising my child. You can’t force me to let my house sit vacant or sell. Have a blessed day.

Let me guess, you are an absentee landlord with a tenant straight out of the trailer park.

And like I said, that's all good.

It's hard for me to comprehend, but obviously lots of people like it.

But we have "bitch about HOA" threads pretty often, so they don't appear to be all great.

I just started a new job an hour and a half away and welcomed a newborn into the world 2 weeks ago. I'm fed up with his shite and him insulting my intelligence when he's clearly in the wrong. If he wants to sling shite, I'll sling shite politely.
