Because this isn't always the case.

The HOA complainers on this board either have only experienced bad HOAs or just heard bad stories about them.

I live in a neighborhood with a good one. Sure they send the occasional goofy letter but they keep my neighborhood value up.

When we first moved into the house we are in now, the garbage service got cutoff unexpectedly about a month in. When i called the service and asked why they told me the HOA put a stop pickup on our house due to unpaid dues. I called the people and asked how we had unpaid dues when we had moved in the month prior and had been told that dues would be paid at the end of the year. They told me the prior owners knew they were moving so they didn't pay and it would be my responsibility to do so. After spending about 2 hours of my life arguing they finally waived it and restored service.

So far that's my only interaction with them. Hopefully it stays that way.
That's something that should have been revealed by the HOA to the title company before closing.

At the end of the day liens do very little (in this matter).

Just like being reported to the BBB. The BBB can't force a business to change its methods, it only takes notes for everyone to see.

1. Find a good attorney that is good with HOA/real eastate.
verify with him that you are in the right.

2. Have him draft a letter to each member of the Board showing that in his legal opinion the HOA president is wrong.

3. Have him ask for the minutes of the meeting where this item was discussed, reviewed, and voted on.

4. Have him Let them know that you will pursue legal action based on the actions of the Board.

If the president is going rogue, his personal protection from litigation may be void.

There is also a rent house NEXT DOOR to mine that hasn't received similar scrutiny or annoyance from captain dickhead.

Well that is a place he f’d up. HOA president can’t randomly apply the rules whenever he wants. Or on this case, broadly interpret or make up what is not stated in the rules.

I fully recommend asserting your dominance by shitting on his porch.

Yall sure you’re dealing with the board and not the hired out company that hands out fines and shite? Our comm managers suck big balls and we as a board are trying to fire them bc they were too rough with the fines and trying to give out fines from different states

Yes. Long story and don't want to type a novel so won't get into details. Stay out of them. I moved from the one I was in after 5 separate fights with them, some my wife never told me about so I wouldn't lose my shite.

I never felt like spending a day at the office and then coming home to fight another battle or have a part time job on the board to fight for my rights.

County is doing a road expansion through neighborhood and purchasing property from homeowners to widen the existing right of way. It’s a forced purchase… imminent domain.

Of course HOA was about 5 months late and now trying to stop it. I was asked to go through our experience with the property acquisition company working for county.

Board members started asking me questions about when we were first contacted, are we cooperating etc… got a bit accusatory.

I finally told them that if they spent as much time keeping up with county road projects as they do fricking with flowers at entrances they would not be relying on homeowners to bring them up to speed on published county road projects. frick them.

Short-term rentals of less than six months are specifically designated as commercial use and are prohibited.

Not sure where you are but that statement isnt true in Louisiana. An HOA can not make up what constitutes and /or decides what is designated as commercial use that differs that state or parish. If the state/parish do not consider short term as commercial, they cant use that as a reason to say you cant. They can put no short term rentals are allowed and members vote however they cant word it like that and expect to enforce it if in la.

And yes. HOAs have some value but when you have morons on the board that use it to pick on people they don't like by manipulating bylaws in a way but meanwhile ignore clear breaks to covenants/bylaws by others as well as theirselves, is where you get the bad taste in your mouth.

But you can get a lawyer and do as was said earlier, but they can do more than just a lien of fines. They can take you to court. Now you may win. But you still have to pay to defend yourself.

The officers of the HOA where we live are, literally, morons.
They seem to have an issue every month.
We just laugh and ignore them.

Tell your tenant to mow their grass and quit parking in the street.

Do your HOA CC&R's disallow local TV antenna on the roof of their house, or satellite dishes?

I believe there's a federal act (cant remember which one) that forbids this. HOAs can mandate dish locations though.
