Try to ignore the guy as best you can and don’t step foot off your property if he tries to engage you. Keep all the videos and consider getting a good dashcam since he’ll probably engage you when you’re leaving or coming home. Look up the legal definition of brandishing a firearm and don’t do it. If the guy has already seen you carrying a firearm, he’ll arm himself. He sounds like the type to escalate and he would make sure it wasn’t a fair fight. Whether you have the law on your side or not, if you’re dead it really doesn’t matter.

Move.


Nails have already appeared on my side of the street on the curb but I don't have any proof of who did it so I didn't even want to bring that up. No construction anywhere around but I caught a nail when I parked on the street and then miraculously nails were only in front of my house, on my curb where we park every now and again when our iron gate is shut.

This house is a rental until my son finishes high school, so long term consequences of a neighbor not liking me doesn't concern me.

I have requested body cam footage but I doubt I get it. I am going to contact the captain and make sure he knows I want to press charges. I guess I could contact the prosecutor if they don't want to press charges? IDK.

The biggest issue is the cops are buddies with him and don't want to do anything to him. He forced their hand today with the threats but they still didn't do what they should have done.

As far as brandishing a firearm, I would never. That is about the dumbest thing you can do. You only unholster it when you need to use it, and hopefully I never need to us it. However, carrying a firearm is certainly not brandishing it.

If you have never been around a tow truck, they are fricking loud. He dispatches from his property. Sometimes he even brings home wrecked cars. You can hear him at midnight, 2am, 4am when he starts the truck. It beeps, the air brakes are loud and then he lets it idle for several minutes. My original request was to just have him not block my driveway but that wasn't reasonable, so now he can follow the law. I don't dwell on it, but if he's breaking the law and I have time then I am calling.

He's up fricking around the area at a time you likely aren't. That'd be my biggest concern.

I'd get a couple more cams - you need more than just the doorbell cam.

If that motherfricker set foot on my property, I’d shoot him. You have instructed him to stay away from you, You have instructed him to stay off your property. And he’s threatened you multiple times. It wouldn’t be unreasonable to assume he meant to do you harm to ignore your instructions.

get a 6 pack. walk over and say, hey bud can you just move it up or back for a few hours until we get moving vehicles in. then deal with the rest later.

That was the original request. It was met with "frick you I park where I want to park" after the second time we asked him not to block the driveway because we couldn't get the trailer in and out without hitting his vehicle. He was already drunk so I don't know if adding a 6 pack would have helped. Like seriously it was "we are moving this weekend, can you not block our driveway this weekend"

Being that this thread is 9 pages long, and involves a tow truck and driver, I'm sure someone has already pointed out that this is strangely headed in the same direction as the "Big Lee" saga.

When you make these requests, ask for “all” of something, not “any”. (All camera footage vs Any camera footage) I don’t claim to understand it but someone said there’s a legal difference. Research to see how long they can take to respond and keep track. Escalate to the State AG, if you need to. Expect a response that they can’t provide it because it’s evidence in an ongoing investigation (the kind that never ends) or they’ll present you with a bill for several hundred dollars to get the goods.

I used "all".

I can't call the 389-2000 line because they call the driver and let him know I called. I asked for a lieutenant to contact me but I don't think that is going to happen, the desk person just takes a message. I guess I will try the Captain on Monday? I could email but I don't know if they even check it....

Edit. Should I call the Sheriffs department about the threats? They are the ones that got in touch with the right people at BRPD to make the guy move his truck in the first place. He just doesn't care though, he knows it is illegal and he is going to keep doing it.

Document, document, document.

(1) As other have said, get every police report call number.

(2) Keep a log of when you call (even if just asking for someone).

(3) Request all body camera in writing with receipts of the request.

(4) Don’t let up on the higher-ups. If you’re constantly calling, they will eventually get tired and tell him to cut out the BS.

(5) Record and film everything. Every time you see him or the cops, record. It eliminates them being able to lie.

(6) Call your city councilman and get them on it. Again, document all communication with them.

(7) Call 9 News Investigates or 2 On Your Side. Nothing gets the cops getting off their asses like a tv camera.

I didn't know if I should go the captain route first or Sheriff first. It is really ludicrous a guy can threaten people in front of the police and they do nothing about it, I really don't know who will help.

OP, do you think you could physically overpower the tow truck driver in a physical altercation?
I'm not advocating for violence, just curious if you feel the need to be armed out of fear on your own property.

Maybe fear is the wrong word there. It would just make a big difference to how I would proceed moving forward being in your shoes.

It was easy to ignore the personal insults, it was very difficult to ignore the insults to my child. I just walked away and will get justice another way.

For those asking, he is a half foot taller and 100lbs bigger.
