Waste of time.
I have heard judges say "I may get overruled, but I am not going to overrule myself".There is no one to overrule these justices and they are not going to overrule themselves.

Yea. I’m not sure SCOTUS has ever granted rehearing and materially ruled different when the full court heard the first case.
There’s a couple instances where there was a vacancy and thus a 4-4 decision where rehearing happened and a definitive ruling was made (as opposed to just upholding the circuit).
The odds of this happening are very low, and the chances anything materially changes with the ruling if it does are even lower.

Congress should grow a spine and define those who have a kid who are temporarily here as in no green-card and those who are illegally here as not being eligible for birthright citizenship.

Here is the very interesting part and I'm not sure it was ever argued
Justice Roberts opinion is based on English common law, however that law no longer exist as England get away with it
Think how stupid we would feel towards another country if they base a recent opinion on Dred Scott or even our own constitution that slaves were not full people

Here is a better idea.
Leave birthright citizenship the way it is.
Cancel the ability of any girl to come here if six or more months pregnant. Wouldn't that accomplish the same thing?
We can end this stuff with a hard core anti immigrant at the border policy position, you don't need a constitutional amendment.

If you want to analyze language used in our early documents up through the late 19th century, understanding equivalent language and clauses in the common law is absolutely critical. It IS the context.
That the UK has since changed its immigration policy and removed birthright citizenship in the 1970’s is irrelevant.

Even if SCOTUS were to overturn itself, or had ruled in favor of the executive order to begin with, won't the next Dim president just overturn the E.O. on Day 1 (as Trump did with all of Biden's, as Biden did with all of Trump's, and as Trump did with all of Obama's)?
It's (way past) time for Congress to enact a permanent fix!
