Waste of time.
I have heard judges say "I may get overruled, but I am not going to overrule myself".There is no one to overrule these justices and they are not going to overrule themselves.

Yea. I’m not sure SCOTUS has ever granted rehearing and materially ruled different when the full court heard the first case.

There’s a couple instances where there was a vacancy and thus a 4-4 decision where rehearing happened and a definitive ruling was made (as opposed to just upholding the circuit).

The odds of this happening are very low, and the chances anything materially changes with the ruling if it does are even lower.

Congress should grow a spine and define those who have a kid who are temporarily here as in no green-card and those who are illegally here as not being eligible for birthright citizenship.

Pretty much. But this is what happens when you have such a useless Congress. We shouldn’t need to be relying on the USSC so much after 250 years.

The Court has been wrong many times. The military plays no part.

Congress historically has to fix it. That or the Court comes around eventually.

That depends on the situation...what if it's proven they are foreign agents?

Military occupation is a temporary measure for administering territory under the control

Occupying Power, the temporarily ousted sovereign authority, and the inhabitants of occupied
territory.

11.1.1.1 Military Occupation, Military Government, Belligerent Occupation, and
Martial Law. The practice of conducting military occupation is very old, and the law of military
occupation has long been part of the law of war.

occupation.

Here is the very interesting part and I'm not sure it was ever argued

Justice Roberts opinion is based on English common law, however that law no longer exist as England get away with it

Think how stupid we would feel towards another country if they base a recent opinion on Dred Scott or even our own constitution that slaves were not full people

Here is a better idea.

Leave birthright citizenship the way it is.

Cancel the ability of any girl to come here if six or more months pregnant. Wouldn't that accomplish the same thing?

We can end this stuff with a hard core anti immigrant at the border policy position, you don't need a constitutional amendment.

Proven to who?

The military regs you reference relate to foreign occupation. Not a domestic coup d’état

How much of the supreme court’s valuable time has been wasted on Trump’s grievances?

English common law is very much still operative. What are you talking about?

If you want to analyze language used in our early documents up through the late 19th century, understanding equivalent language and clauses in the common law is absolutely critical. It IS the context.

That the UK has since changed its immigration policy and removed birthright citizenship in the 1970’s is irrelevant.

I was surprised that it was as close as it was.

I was thinking 2-7.

Even if SCOTUS were to overturn itself, or had ruled in favor of the executive order to begin with, won't the next Dim president just overturn the E.O. on Day 1 (as Trump did with all of Biden's, as Biden did with all of Trump's, and as Trump did with all of Obama's)?

It's (way past) time for Congress to enact a permanent fix!

Do what needs to be done to stop this stupid approach. Give every
female that comes to a State or territory a pregnancy test and an ankle monitor.

Tired of a anti-American Democrats destroying our culture. Evil scum. All of you who lean left.
