IF I was on the jury, jury nullification would be the verdict.

Look the guy screwed up. Just convict him, let him pay the 10 dollar fine and be done with it.

"Virtue signaling" involves expressing a position to gain accolades from those hearing it. In this forum, my position on this point is hardly going to gain any accolades.

Here, "Virtue signaling" would be something like the following:

They should be able to put the packages at the end of my driveway on a fricking eight lane main thoroughfare and people leave my shite alone. What the frick is wrong with people that think like you do?

Well the law saw it's OK to use lethal force if you are in reasonable fear of your life.

Does this not qualify?

Someone is trespassing on your property in broad daylight, they are entering your premises by coming onto your porch.

They are stealing from you. Do you know their intent? Do you know their intent once they are confronted committing a felony on your property? Do you know if they have a weapon or not?

The answer to all of those is NO, which means that it is reasonable to assume that they are their to harm you.

IMO, here is where this fails and he would lose that defense. How does he know they are stealing from them but not know if they pose some sort of threat to him or his family.

What if they were coming on his porch to knock on his door, but since he doesn't know their intent your line of argument suggests it is ok for him to shoot first.

If you are unsure if they are armed, and none of their actions indicate an immediate threat to yourself or your family; I am pretty sure the law would not give you the all clear to begin firing.

What does the law say?
I really don’t care what the law says - jury nullification is part of our law and I would NEVER vote to convict the homeowner in that case - hopefully, there are enough people like me to make a difference

There’s a ton of ignorance on this thread on how self defense works and when it is lawful. Based on the facts so far, the homeowner is screwed. In order to use deadly self defense (shooting at someone is deadly self defense) you have to be under an imminent threat of death or serious bodily harm. Just trespassing doesn’t cut it.

So can neighbors. Pro-tip: if you have neighbors who look like this, it is time to find a new neighborhood.

Only state in America you can use deadly force related to theft of property is Texas.

Yup, I think Texas is a little different, but almost everywhere else you gotta at least be able to claim you feared for your life or someone elses life.

don't disagree. lots of things should be different than they are.
doesn't change the fact that if you're concerned about packages getting stolen, you can have them delivered to thousands of secure locations

Given the gravity of the consequences, I need to check again, but o do believe I was told I can shoot someone who is breaking into my truck in Arkansas
