“Trading five senior Taliban leaders from detention in Guantanamo Bay for Bergdahl’s release may have consequences for the rest of our forces and all Americans. Our terrorist adversaries now have a strong incentive to capture Americans. That incentive will put our forces in Afghanistan and around the world at even greater risk,” House Armed Services Committee Chairman Howard P. McKeon (R-Calif.) and the ranking Republican on the Senate Armed Services Committee, James M. Inhofe (Okla.), said in a joint statement.
Lawmakers were not notified of the Guantanamo detainees’ transfer until after it occurred.
The law requires the defense secretary to notify relevant congressional committees at least 30 days before making any transfers of prisoners, to explain the reason and to provide assurances that those released would not be in a position to reengage in activities that could threaten the United States or its interests.

A senior administration official, agreeing to speak on the condition of anonymity to explain the timing of the congressional notification, acknowledged that the law was not followed. When he signed the law last year, Obama issued a signing statement contending that the notification requirement was an unconstitutional infringement on his powers as commander in chief and that he therefore could override it.
So, he signed a law he knew he wouldn't follow? Well, at least he's consistent.
When I first started hearing the term "Imperial Presidency" about 5 years ago, I thought is was a bit of hyperbole. Not anymore.

I thought I saw somewhere that this isn't in effect yet. But besides the point very stupid that he did it.
Regardless or not of what the reason behind all of this is, Berghdal didn't follow code of conduct. He should be punished for that.
Him not following the code of conduct ( Taliban videos of propaganda, no signs of pain and wounds ) makes me think that he was a deserter and had relationship with whomever he was in custody of.

2 other issues..
First the people he let go were high ranking.
Second, he just put another target on soldiers... They will now start capturing them.

It did get mentioned and talked about later in the thread, was just letting you know if you felt like reading what was said. Wasn't calling you out for starting a thread focusing specifically on the topic.

He is smart.
1- The GOP is not going to complain too loudly. They don't want to be seen as a cold hearted party.
2- His numbers are low.. Needed something to make the libs and young people who do not understand to cast some praise his way.
3- He had a horrible, uncomfortable time at West Point. Surely this will send the message that he CARES deeply about them.
4- He needs these terrorist in the countries that he has destablized to help out the cause. Else, we wasted a lot of money and guns. Right?

Apparently you don't understand ObamaLaw. If Obama doesn't like the law, he doesn't have to follow it. He'll just issue an executive order saying the law is racist, and viola, there is no law.

yeah, nothing will happen to him. he's the president, he is the law.

What's illegal? The president has unquestioned authority from the Constitution to grant pardons and reprieves. He doesn't have to ask permission from congress.
