As a general principle of law electronic writing is writing.

When Trump deleted a tweet, he likely violated the President Records Act, a 1978 law that requires all presidential writings be preserved. Congress recently amended it to include electronic records.

I mean, I guess some lackey at the National Archives could be assigned to constantly monitor his Twitter and make sure they are archiving everything he puts there, no?

Those tweets are still available, not permanently destroyed.

I do think he needs to stop with the tweeting but to act like he broke the law because he deleted tweets is ridiculous. The law was created to ensure transparency. Trump is the most transparent world leader in world history. Probably too transparent as we seem to get every thought that ever went through his head. This isn't deleting a secret email to make sure that some investigative Journalist can't uncover wrongdoing with a FOIA request, this is 140 character of Trump calling someone an a-hole, that by the way he blasted out to everyone in the world who has a computer or cell phone.

Well, I guess breaking the law is breaking the law.

That said, I'm having a hard time giving a rat's arse about his Twitter feed. IMHO, he should forget about it.

Our good friend James Comey wants to chime in on this.

quote:

"In our system of law there's a thing called mens rea. It's important to know what you did. But when you did it, this Latin phrase mens rea means: What were you thinking?" he said, waving his hands like a law professor in front of a classroom of first-year students (we assume.) "And we don't want to put people in jail that they knew they were doing something they shouldn't do."

Clearly this qualifies as high crimes and misdemeanors.

Meanwhile dropping classified information like candy is fine, and gets you almost elected.

Dems suddenly concerned about deleted messages.

Except this is over a completely inconsequential tweet instead of highly classified material.

Is it perverted that I am almost aroused by the mental breakdowns from the left?

IDGAF about these tweets, but can we please stop the "but but but the media/HRC/Obama" stuff.

Trump's actions need to be good or bad, right or wrong, on their own merits at this point. Comparing stuff to HRC/Obama or excusing things because the media would cover the other side differently is not a good way to rule.

How does NBC have a record of the Tweet Trump deleted if he apparently deleted it?

They didn't give a shite when Hillary deleted 30,000 emails and used unsecured servers for top secret communication but they want to claim that Trump posting a tweet from a blackberry is illegal?

Please try to make a big deal out of this.

To be fair, they did when Bush was deleting messages as well. There's 30,000 emails that were deleted leading up to the Iraq war that were recovered.

They're not available for public dissemination, however, as they are classified.

So, they aren't suddenly concerned... they just sorta "stopped" being concerned, temporarily.

You know, one of those 8 year hiatuses.
