That's not exactly how the law reads, but nice try. Try reading the statute in full.

I am sympathetic to your stated desire.
BUT - we live in the world we inherited, not the perfect world of our dreams.
I consider our current dilemma as being the only doctor on a battlefield after a bloody year's long struggle where the only logical approach to do the most good is triage.
Knowing that there will be cases where someone in critical condition may have been saved had I devoted 2 full weeks of devoted care to his care.
But also knowing that in those 2 weeks FIFTY other seriously injured victims would perish because of lack of ANY care.

I liken this to being the owner of a very nice home returning after a 4 year absence only to find that my neighbors had been using it for a dumping ground for his illegal trash recycling operations.
And as I begin cleaning up the smelly infectious pile of crap, he begins filing lawsuits against me for not preserving any possible valuable relics he mistakenly put in there - forcing me to examine every single item and spending weeks, if not months, to obtain unanimous approval from a group of disinterested magistrates in other states before I can remove a single item.
Nope = I am going to back up the largest dump truck I can muster and move that shite out as fast as I can - and attempt to resist the urge to shoot the bastard neighbor right between the eyes. Now, I admit, there may well be a golden watch in that mountain of trash, but I do not have the time, nor the inclination, nor the wealth to do the search, to avoid his loss of HIS fukcin' watch.

The federal government is casting a wide net by necessity due to what should be considered a criminal lack of border enforcement by the previous administration. Over time that will change, but until then these events will happen. Such events should be reviewed away from the hullabaloo of mob mentality reacting to the selective reporting of the media, but that takes time and manpower.

God they need to teach Civics in school again.
Here is your brief Civics lesson:
ICE is law enforcement. They enforce the law. She broke the law - even if you consider it only a “technicality.” They shouldn’t pick and choose what immigration laws they enforce.
The court/judicial system interprets the laws. They can review the “technicality” and determine the outcome.
Congress makes the laws. If they don’t want this (or thinks their constituents don’t want this) then they change the laws.
It seems like ICE enforcement is doing exactly what they are supposed to do.

Look when you get a drunk driver the police should give him a citation and a court date and then let him drive home drunk.
Because once it's in the court system it's best to let it play out with a judge.
