The kid was having a massive panic attack on the stand. Ordinarily most people don't cry with tears during a panic attack.

It's so weird to hear talking heads saying the prosecution hasn't met the burden of proof and is doing a bad job. They always carry the water of the prosecution in these political trials.

Sorry if this is a dumb question...I have seen some people saying the prosecutor is aiming for a mistrial at this point. What would be the benefit of that? Does that mean it all has to start all over because he's losing so bad?

Or does it mean it gets dismissed and thrown out and he doesnt have to take the L.

yep. intentionally throwing it so they can start over with all this info in the record so they can avoid their mistakes a second time and maybe get a more politicized jury.

but if the judge declares mistrial with prejudice then its over so this is a very thin line they're walking if they're trying to do this.

It means you get a second shot at prosecution. Better Jury. More prep. Knowing the defense's plan.

But if it's a mistrial with prejudice, they don't get a second chance. Defense wins.

If its a mistrial, the Prosecutor would have to decide if this case should be have another trial and start all over again. He would probably let it die.
