I think the state gets a do over with mistrial. But I also think this judge does not believe Kyle should have to go through this again. The judge does not want a mistrial I would expect him to take this away from the jury and give a direct verdict.

I’m obviously not an attorney and certainly have idea about Wisconsin law.

If it's a mistrial, they can try it again. Unless the judge orders a mistrial with prejudice, then it is over.

He's already intimated mistrial with prejudice due to the ADA's actions.

I don’t believe the Judge will declare a mistrial without some really egregious errors, like jury tampering/witness tampering. I also don’t believe the judge will issue a direct verdict. This thing will finish, it will go to the jury. It’s the only way it can happen.

Whoa man, calm down. Did you not read the post?

I just thought it was odd he didnt have actual streaming tears. Ive never had a panic attack and that seems to be what most people think it was not emotions that would cause tears. Im so fascinated by the psychology of the whole trial, Binger being a dick, the more relaxed tone of the defense in general, the judge, and of course Kyle and his reactions. No one said anything about convicting him because he was fake crying. Did I say he was fake crying? Chill yourself friend.

the judge is trying to do everything within his power to avoid a mistrial b/c he probably has a read that a not guilty verdict is better than a mistrial... whether it be with or without prejudice

but if the prosecutor gives him 1 more reason to declare a mistrial with prejudice... I think he takes it
