Judge Temporarily Blocks Mamdani’s Pied-à-Terre Tax

The ruling came in response to a Friday lawsuit from a group of three aggrieved homeowners suing to delay the rollout of the tax because of how it has been executed so far.
Wayne Ozzi, a state judge in Staten Island, entered a temporary restraining order mandating that the Department of Finance remove the tax roll of 960,000 properties that it published last month as part of the pied-à-terre tax rollout.
The court also banned the city from taking any additional enforcement action on the tax warning notices that have already been mailed to 17,000 homeowners.
The next hearing is scheduled for the afternoon of Aug. 31.
The lawsuit isn’t challenging the legal basis for the pied-à-terre tax as a whole. Rather, it argues that the rollout has been botched so far. The plaintiffs—Rachel O’Brien, Carmine Morano and Simon Hedley—are New York City residents who say they were falsely targeted with the pied-à-terre tax notices and are now scrambling to prove that they live there.
So it begins. I am genuinely curious if he will ever get this done and what the outcomes will be if he actually does. Will people sell their properties or just suck it up and pay the tax?

It was an issue in implementing the tax plan. Not the plan itself that was contested.
They sent out letters stating you owe the tax and put the onus o. The homeowner to prove they lived in the tax.
Judge said there were easy ways the government could determine if the house was a primary house based on Tax filings.
Judge said onus was on government to do due diligence before sending out tax bills.
This will just delay the tax not end it.

My prediction is that there will be additional lawsuits filed between now and the final ruling on this. It is the way the game is played. You file suit after suit and run out the clock on this commie.

shite like this is why Louisiana ended up on the hook for a number of tax grabs that backfired.
The main one I’m thinking of is the “no insurance on car” one.
They sent out demand letters with no real recourse to contest it. Turned out the plates in question had been turned in to Dept of Public Safety and they couldn’t be bothered to mark it as surrendered in a timely fashion, resulting in a gap between insurance coverage date and surrender date.
Short form - Check your data carefully before you start demanding money off it, lest you lose more money in lawsuits over how you fricked up your attempt to collect.

Some will suck it up and pay it and some sell their house to people who will actually live in those high end homes and spend their money there.
Mamdani sees this as a win win scenario.

Trump owns some pretty high dollar real estate in New York, including at least one home that is probably subject to this idiotic tax. Hes not really an outsider in this fight.
