He's walking towards her and looked like he was doing the front flex in that video. Regardless of color, she has clear justification that she was afraid of him.

What if it was a white female oil-field wife with her kids gun holder and a black male playing the part of the guy? How would people here feel?

How can you call this an ambush? What a joke. She is standing there with her pistol and he aggressively comes at her. This is a clear stand your ground case and this woman should not face any criminal charges. She has NO duty to retreat and is exercising her 2A rights. Race has nothing to do with this and it would be a travesty for this woman to be prosecuted. Florida is a state that supports the Second Amendment and the right to defend yourself, which is all this woman was doing.

Tell us you have ZERO clue about how self defense laws work without telling us.

1. She committed a felony just by pulling a gun in a verbal altercation
2. At no point was she in danger of any unlawful deadly force from the victim

Unless there is more to this murder than I've seen, this woman is going to jail for life.

Dumb of him to approach her, being that he should be aware of her hatred of him based on his race to begin with, but he never brandished a weapon. Her goose is cooked.

Chud's bond was set at 1.25 million and he was literally physically assaulted. This racist bit(h won't receive a bond.

It was an ambush.

She got out of her vehicle with the gun in hand to engage in the argument. She can’t reasonably claim that she feared death or great bodily harm. That’s murder.

I knew within the first few sentences that this was fatigue related.

Looking at the video a few times, he walks toward her casually and she shoots him. At the start, his gestures are calm and dismissive, but perhaps she took that as "disrespect."

Does Florida have chain gangs working the roads these days?

Florida has a stand your ground law

quote:

person is justified in using or threatening to use deadly force if he or she reasonably believes that using or threatening to use such force is necessary to prevent imminent death or great bodily harm to himself or herself or another or to prevent the imminent commission of a forcible felony. A person who uses or threatens to use deadly force in accordance with this subsection does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be.

That's directly from the law.

Yup. Once you pull a gun in a verbal altercation, you lose self defense justification

I'm inclined to agree. At some point, you have to wonder what in the world he was thinking.

That’s not the requirement.

They have to reasonably believe that they are preventing imminent death, great bodily harm or the commission of a forcible felony.

Furthermore, they cannot be committing a crime.

I would argue she was improperly exhibiting a firearm prior to shooting him. That removes the SYG defense as well.

She may have "felt" threatened...but it didn't look like she "was" threatened by him pointing.

Where in the video do you see her at risk of imminent death or great bodily harm?

Well, one could argue that if a woman is holding a pistol, and facing down a physically superior threat, that if she allowed the threatening individual to get close enough to take her weapon, she would have been risking those things.

As I said, you have to wonder what the man was thinking, and you have to assume the woman was wondering the same thing. All because he was apparently pissed off that she took his parking spot at a Walmart. If a stranger is crazy enough to repeatedly approach her under those circumstances, no telling what that individual is capable of.
