I dont know if Trump can technically pardon Penny but if he can he absolutely should, then give him a medal

ETA, never mind, I misread. The DA dismissed the charges. Yeah, it's a ploy by them, but hopefully there's enough hold outs on the jury for this guy not to bite on it.

But he wasn’t acquitted of manslaughter. That charge was dismissed. (Not sure with or without prejudice)

I thought they had gotten an actual jury ruling on THAT charge, and were still holding out on the other, which would have been seen as nothing but good news for him. I still think, it shouldn't be seen as a negative development for him.

Does NY not have lesser included charges? Can they only deliberate on one charge at a time? That's my confusion.
It seems the criminally negligent homicide was billed, but they're making them come back for just that?

Yeah, I don't know about that either.
I'd like to think there would be at least one or two jurors able to sniff out some possible frickery afoot based on this either way.

Napkin "math" but I have to imagine there is one holdout in perpetuity/across the board because they didn't deliberate that long.

Won't happen in NYC, but some locale of a more nobler disposition should make a statue of the choke-out. Same with Gary Plauche.
