He did share a name with a drug lord that was on the loose and had faked his death.

https://news.sky.com/story/wilmer-chavarria-ecuadorian-drug-lord-who-faked-his-own-death-and-ordered-assassinations-is-captured-says-president-13471533

Was not caught until November. They looked similar, just throwing it out there.

What CBP is asserting here is not routine border authority.

Is this what CBP is asserting as an organization, or did one officer say something that was incorrect?

One of the leading cases on the issue is U.S. Flores-Montano where it was held:

quote:

Congress has always granted the Executive plenary authority to conduct routine searches and seizures at the border, without probable cause or a warrant, in order to regulate the collection of duties and to prevent the introduction of contraband into this country. Montoya de Hernandez, supra, at 537. Respondent’s assertion that he has a privacy interest in his fuel tank, and that the suspicionless disassembly of his tank is an invasion of his privacy, is rejected, as the privacy expectation is less at the border than it is in the interior, id., at 538, and this Court has long recognized that automobiles seeking entry into this country may be searched, see Carroll v. United States, 267 U. S. 132, 154. And while the Fourth Amendment “protects property as well as privacy,” Soldal v. Cook County, 506 U. S. 56, 62, the interference with a motorist’s possessory interest in his gas tank is justified by the Government’s paramount interest in protecting the border. Thus, the Government’s authority to conduct suspicionless inspections at the border includes the authority to remove, disassemble, and reassemble a vehicle’s fuel tank. Pp. 2–7.

A computer might be different, though.

Like Antonio Moss said, there's plenty of precedent on this. Re-entry isn't the same as being detained by an officer while you're out minding your business. They might have overstepped with some of their actions, but extra screening and temporary detention probably isn't crossing a line

My wife and I have also been detained and had our luggage manually searched in the Atlanta airport. Took well over an hour, not four, and almost made us miss our connection. It is not uncommon for them to want to know about everything you are bringing into the country. They did not search my laptop however.

Most of us do not trust the government at all. That is why we are fans of smaller government.

At this point I wouldn't say "most". It is proven here daily that many of those who say they distrust the government, even hate the Federal government, seem to forget all of that when their side takes control.

It is interesting, though has nothing to do with this case - that the guy detained is the Superintendent of a school system i Vermont that recently started flying a Somali flag dues to Trump's remarks on the country.

He retains his rights. Especially 4 hrs later when they were absolute, as to who he was.

If it happens under Trump its okay, if it happens under a Dem its completely unconstitutional and this should blow up.

This situation seems different than a vehicle crossing a border. Searching password-protected electronic devices vs a gas tank.

Is posting this story equivalent to getting "your Constitutional law views" from a travel blog?

When you falsely title the thread as "CBP says Americans have no Fourth Amendment rights at airports", yes. You are equating a factually incorrect article with your personal opinion.

quote:

What websites am I allowed to source news from? A list would be helpful.

A reasonable person would use discernment anytime a journalist with no legal training opines about the Constitutional legality of an action. At a minimum, you could have taken ten minutes to look into the issue before sprinting here to post it.

And you don't find this concerning?

This has been the law for almost 50 years and you didn't find it concerning until a travel blog told you to.

And no, I fully understand and accept that Fourth Amendment search and seizure rights have less protection at US borders, the same way I understand that Second Amendment rights offer less protection in school zones.

Yeah, I actually get physical searches, as that might reveal an immediate threat to the safety of others.

Computer passwords? frick that.

This is one of the reasons I don't do international travel. It is known you are expected to hand over your electronics and unlock them if asked at border and customs check points.

There are ways to create hidden users on some of my devices but if that is detected you'll be under even more scrutiny. It is recommended to have a second device with no personal information just for travel.
