So glad people like aunt Becky are off our streets

so crucify her?
when the prosecutor says "plead or we will file a superseding indictment" and you make him/her do that, what do you think can be done?

She shouldn't face severe jail time.
i get that. i'm one of the biggest proponents of how over-criminalized our society is, but it's still our reality
she got a chance almost anyone else would not get and she blew it, quite arrogantly. she has to live with that choice

Decatur will be bear shortly to tell you how crazy you are and how Flynn is guilty because he plead to the charges.

I'm comparing a wrong to a wrong - a felony. She shouldn't get life like an accessory to a murder does but she sure doesn't deserve to skate just because no one was physically harmed. Bernie Madoff says hello if you believe she shouldn't go to jail. He didn't kill anyone either.

What was done to Flynn was the height of anti-American treason.

That checks out.

Having said all of that, worst case is probably a 5-year sentence, with 4 suspended and she probably does 30 or 60 days of that year before being paroled.

I'm not suggesting that anything could have been done differently at that point. I'm responding to the comments that, because she declined the plea, she should now face SERIOUS jail time.

The tax evasion is serious. She should face whatever the typical penalty is for tax evasion if she is indeed guilty of that. I haven't kept up with this story, so I have no idea of that's still part of the indictment.
I don't really see much wrong at all with them paying for admission. Whatever punishment being sought here should be extremely minimal.

Rarely a good idea to take on the Feds.

Yup, tax evasion is what is going to get her. The G men need their cut. And for the record, aunt Becky needs to do some time. No way should there be a 2 tier justice system.

Agreed. If she is convicted of a crime, there should be a punishment. Nevertheless, the punishment should not increase from 48 hours to some draconian sentence because the prosecutor and judge have to do a little more work to ensure that she obtains her constitutional right to a trial.

I bet they’ll beg for another plea deal if they aren’t already. They’ll have to sweat it out but they’ll get one. At least some of the charges that were added will be dropped and they’ll each do 3-6 months with a big fine.

If I was her attorney, I sure would like to try to get her off

Not in the federal system, there is no more parole. On a one year sentence you can expect to do just over 10 months with good time credit.
Do you not still get 20 days off for each month of good behavior?
So ordered to serve 1 year of a five year sentence in the federal system would mean 140 days off for the first seven months so she would only serve seven months and ten days of her one year sentence.
Did I do that math right?

Why not? The prosecutor is offering you a soft landing and a way out. Once you to trial, you get convicted, the judge’s hands are tied due to the sentencing guidelines they must follow. It’s a gamble and the Feds own the house big time.

To the best of my knowledge, there is not any charge of tax evasion on how we would normally thing of the charge (e.g. a 7201 violation). There was a second charge added for money laundering because the money was paid to a false charity set up by Singer. I think this is the last indictment, but if there is a new one, I'd be interested in seeing it.

Madoff seriously injured people. I think you are failing miserably at the equivalency game. It’s almost as if you don’t know how the names get on university buildings or what a legacy admission is.

Yes, and the difference between the choice should not be 48 hours or 48 years.

Call your congressman then and then get him/her to draft a bill reducing draconian sentencing guidelines. Until then, Aunt Becky is going all in against the house and could severely regret it.
