Dershowitz has lost more knowledge on constitutional law than you and I together will ever have.

So you have faith in the corrupt two tier justice system or you're speaking as a never Trumper?

Dershowitz keeps claiming this is a First Amendment case. It is not. The indictment specifically states Trump has a right to voice his opinion about the election, and even lie about the election if he wants to. Trump is not being indicted for statements made in his Jan. 6 speech.
The First Amendment does not protect your right to commit a crime. If your speech is part of a fraudulent conspiracy, you aren't protected.
I think the indictment might be a stretch on fraud against the US, but you can expect to hear more evidence as co conspirators get charged in superceding indictments.
If you were correct about this, Smith would not have manipulated Trump's comments when he quoted him in the indictment.

Good to know. With that logic every person who spread Russian collusion lies will now be charged for trying to overthrow a democratically elected president.

They are not going to prosecute him over things he did in his government capacity. And I know that’s rich considering what they are doing to Trump

Please. It's an indictment. It isn't evidence. There is plenty of time for the DOJ to present evidence and the Defense to rebut.
But also, Trump is not being indicted for inciting the Capitol Building demonstration. The groups and individuals who participated in the demonstration are not part of the alleged conspiracy.

Wouldn't the DOJ's jock strap lawyer have to prove Trump didn't believe he lost the election in order to prove a crime?

INVALID PREMISE!!
Because AggieHank has not appeared to set the subject straight - that's how I know

Patriots are in control. Trust Dershowitz.

That's a little unclear, because the law is so vague.
For something like his phone call to the Georgia SOS, it probably wasn't fraudulent if Trump truly believed his facts were correct (even though he had already been told they were not correct). If he honestly thought there was a legal way to reverse the GA results, then that phone call may not have been fraud.
But the scheme to submit votes from fake electors and have Pence throw out the legit votes is fraudulent even if Trump believed he won. You can't accomplish something illegally just because you believe you were cheated.
Say you thought you had $10,000 in the bank, but the bank says you only have $2,000. You're mortgage is due and you are about to be in serious trouble. You can't just go rob the bank and try to justify it due to the bank's error. You need to recover your money (plus any damages) through legal means.

It's just another "get Trump" fabrication by another TDS demprog who is undermining the shreds of credibility the judicial system has left.
Meanwhile, Biden and son have been caught extorting a 10 million dollar bribe from Burisma among other things.

We just need smaller nation states. This experiment has failed. Humans like smaller homogenous like minded territories.

I don't think Trump asked or ordered Pence to throw out elector votes. Trump and many others asked Pence to pause and have an audit, which he could have done.

Any Judge true to the Constition and right to free speech would sanction Jack and suggest he lose his law license.

I’d like to air some legal grievances against some government officials then.
