conversion
n. a civil wrong (tort) in which one converts another's property to his/her own use, which is a fancy way of saying "steals." according to law, anything found that has something to identify the owner is lost property and you cant keep it or you stole it. same rules apply to losing your wallet.
now if there is nothing with your name on it and no registration or identifying marks then its found and finders keepers its yours

The kayak has a vin number and owner has said number in his possession plus hobie has a record of the number.

FWIW, I always tie on a safety teather to each kayak I tie down. Its independant to straps and uses separate mounting location both truck/trailer and kayak. Overkill Im sure, but I havent lost one yet. Ive been with others that will only use a single Harbor Freight ratchet strap on their PA14.
