Woman loses home after HOA auctions nearly $500K home for $30K

Frick HOA's. Each situation needs to be looked separately.

A Las Vegas woman's home, worth almost half-a-million dollars, slipped away for just $30,000 at auction.
quote:
Contact 13 uncovers how that could happen and why paying your mortgage could take a back seat to what you pay your homeowners association.
quote:
Nevada law allows HOAs to auction off houses when a homeowner falls behind on their association dues. It's called a Super-Priority Lien. And it means an HOA can sell your home out from under you and possibly your mortgage lender.
quote:
"It's insane. You can't even find words to say," says Nenita Neff.
quote:
She'd fallen on hard times due to a series of severe medical problems. She had family members pass away, the economy tanked and she filed for bankruptcy.
quote:
Behind on both her mortgage and HOA dues, Nenita never recovered. So it was time for a short sale.
quote:
"Getting so close for us to materializing in getting it done," Nenita explains. "So that I get out of this nightmare." Working with a realtor, Nenita understood the short sale would provide her with $20,000 for relocation.
quote:
But that would never come to pass. Nenita was shocked to find out that while her short sale was in progress, her house went to auction. Sold by her HOA over unpaid dues.
quote:
The HOA says Nenita never told them about the short sale. Nenita admits to that saying her health problems and other issues were a distraction. County records show the house Zillow estimates at $430,000 was auctioned off for a mere $30,000.

The HOA provided the following statement:“It is regrettable that years of resident non-payment of assessments and non-communication eventually leaves an association board no other option but to exercise the collection process put into place to protect all residents”

Scum of the earth if they knew the situation.

I realize situations change and the unthinkable can happen but why are you not upset with the woman for not downsizing instead of essentially squatting
I agree that the law is crazy though.

Those are always open to fraud. If you look closely at many of these, I bet the ones pushing these through are in the back pockets of some real estate person that stands to make a profit on this.

It did say years of non-payment and non-communication. A phone call or a face to face conversation might have allowed her time to sell the house and pay the dues and whatever late fees

They didn't. The homeowner admits she didn't tell the anything.

Good grief.
That’s insane and infuriating.

People should stop ignoring the 50 page HOA agreement that comes with their new house. Nobody is forcing you to agree to it.

Wouldn't you love to be the new owners?
I'd flip that house faster than the ink could dry for a $400k profit then use said profit to buy another home.

I bet someone at the HOA got soooo excited that they got to play the big man like that and host an auction for a home. It always makes me think of the scenes from Seinfeld when he visits his parents in Florida
. I always imagine super petty politics and ridiculous rules and rumors going on with HOAs.

Very much so.

How does the HOA not realize that this hurts the neighborhood? Values would plummet.

Louisiana allows foreclosure by HOA as well.....

Well if they’re allowed by law to do it and they have no other reason to believe they shouldn’t, it’s a shitty situation. Still not scummy as if they knew the details and did it anyways without trying to help her out.
